Comments:
An unannounced monitoring inspection was initiated on 08/06/2024 and completed on 08/19/2024 in response to a self-report received by the licensing office on 08/05/2024 relating to the supervision of children. The inspector reviewed 1 child record and 2 staff records. This inspection included document review, a tour of the facility, interviews, observations, and measurements.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 08/26/2024. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on a review of documentation, video footage, and interview, the center did not ensure that their operational responsibilities included ensuring that their activities and services were maintained in compliance with the center's own policies and procedures that are required by these standards.

Evidence:
1. The standards require the center to have a procedure for identifying where attending children are at all times, including procedures to ensure that all children are accounted for before leaving a field trip site and upon return to the center. In interview, administration identified a name to face procedure in the handbook. The policy states that each time the class enters or exits through any door in the building, a name to face check must be completed on the Check In/Out Sheet BEFORE entrance or exit. The handbook states that staff are not permitted to exit the vehicle if students are aboard. The handbook also contained a policy that upon arriving to the center from a trip, the driver must 1. call the center to request a MANAGER for a bus sweep. If a manager is unavailable, a staff may be sent as a designee. 2. Walk to the back of the bus to ensure that all children are awake and alert. Only drivers can push the red safety button, and under no circumstances can a child push the red safety button. 3. With a Manager or Staff Member present, use the check on/off list to exit the bus. Name to face recognition must be used. 4. After all students have exited the bus a manager, staff member or driver will verify that all children have been removed by walking to the back of the bus. The Manager or designee will also confirm that all children not checked on and off are absent and a confirmation call has been made to the parent if parent communication has not already been made. Manager/Designee initials required.
2. In interview, staff #1 and staff #2 acknowledged that they did not conduct a name to face before the children entered the building from the bus and acknowledged that the staff exited the vehicle with the child unknowingly left aboard. Administration stated that they were not called to perform a bus sweep.
3. Administration acknowledged that the center's written procedures were not followed.

Standard #: 8VAC20-780-340-A
Description: REPEAT VIOLATION

Based on a review of documentation, video footage, and interview, the center did not ensure that when staff are supervising children, they always ensure their care and protection.

Evidence:
1. On 8/5/2024, the department received a self report stating that on 8/2/2024, child #1 (age 6) was left unsupervised on a bus for approximately four minutes after the school age children and staff returned from a field trip. In interview, staff #1 stated that two buses that were transporting 15 children arrived at the side entrance of the center to unload. Staff #1 was riding on the bus driven by staff #2. Staff #1 unloaded her bus first, and then proceeded to unload the second bus that did not have an additional staff member aside from the driver. Prior to unloading the second bus, a child reported that there was a child that had fallen asleep on their bus. Staff #1 stated that before she could check, the buses had left to park in the front of the building. She stated she conducted a quick headcount and believed she had 15 children and the child had returned. She then took the children into the hallway towards the main front lobby to use the restrooms. She reported that while conducting another headcount she determined that child #1 was missing. Within moments, she saw child #1 approach the front doors and let him in the building. She stated that the child reported he was sleeping and was left on the bus.
2. In interview, staff #2 stated that when she parked the bus, she did not hear or see child #1. She stated that she did walk the bus, but was not sure if she walked all the way to the back. Once she returned to the building, she went to the two year old classroom and was not aware that child #1 had been left on the bus. In video footage, teacher #2 was observed leaving the bus and walking across the parking lot to the center. Approximately four minutes later, child #1 is observed opening the doors and running across the parking lot to the front doors where staff #1 saw him and let him in the building. The distance between the parked bus and where staff #1 was reportedly standing when she saw him measured approximately 90 feet. In interview, both staff #1 and staff #2 stated it was a very hot day. The weather reports indicated the temperature at the time exceeded 90 degrees.
3. Administration acknowledged that child #1 was not appropriately cared for and protected.

Standard #: 8VAC20-780-340-F
Description: Based on a review of documentation, video footage, and interview, the center did not ensure that children under 10 years of age always were within actual sight and sound supervision of staff as required.

Evidence:
1. On 8/2/2024, child #1 (age 6) was unsupervised for approximately four minutes. Video footage shows staff #2 exiting a parked bus at approximately 12:18 pm and child #1 exiting the same vehicle at approximately 12:22 pm. Child #1 is observed running from the bus to the center's front door where he is let inside by staff #1.
2. Administration acknowledged that child #1 was not within sight and sound of staff during the reported incident.
