Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced inspection was initiated and completed on 8/1/2024 in response to a complaint received by the licensing office on 7/26/24 relating to allegations of supervision. This inspection included document review, tour of the facility, interviews and observations. The preponderance of evidence gathered during the investigation does not support the allegation; therefore, the complaint is determined to be not valid. Though not a part of the original complaint, violations that were not reported were found related to documentation of injuries and are documented on the violation notice issued to the program.

Standard #: 8VAC20-780-550-P Complaint related: No Description: Based on observation and interviews, it was determined the facility did not ensure that the center maintain a written record of children?s serious and minor injuries in which entries are made on the day of occurrence and contain all the required information.
Evidence:
1.The injury record for child #1 did not contain the time the parent was notified.
2.The injury record for child #2 did not contain documentation of the date, time, and method that the parent was notified.
3.There was no written record for a bite injury that occurred on 7/23/24.
4. The Director confirmed the required injury documentation was not in the records.Plan of Correction: The center responded with the following: In August staff were re-trained to ensure that all injures are documented and include the required information.
