Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The Department received a complaint alleging non-compliance in the areas of supervision, diaper changing and food services on August 12, 2024. An unannounced complaint inspection was initiated and concluded on August 27, 2024. The licensing inspector was on-site from approximately 11:30am until 12:45pm. Interviews with the staff were completed, observations were made, and documentation was reviewed.
The preponderance of evidence gathered during the investigation does not support the allegations; therefore, the complaint was determined to be not valid. Although not complaint related, violations were cited during the inspection. Please see the violation notice for additional information.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice, sign, and return it to me within five business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the stand(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Standard #: 22.1-289.035-B-4 Complaint related: No Description: Based on a review of two staff records and interview, the center did not ensure to request an out-of-state child abuse and neglect background check for two staff members by the end of the 30th date of employment from any state in which the individual had resided in the preceding five years as required.
Evidence:
1. The records of Staff #1 (date of employment: 05/28/2024) and Staff #2 (date of employment: 03/26/2024) contained a sworn statement that indicated that the staff resided out of state within the preceding 5 years. The record did not contain a central registry request for the state listed.
2. Administration acknowledged that the request was not in the record and had not been completed.Plan of Correction: Not available online. Contact Inspector for more information.
