Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, on-site renewal inspection was initiated and completed on 8/30/2024 as a part of the provisional licensure period. The on-site inspection began at 8:23 am and ended at 1:20 pm. The inspector reviewed compliance in the areas listed above. There were 20 children present and 6 staff. The inspector reviewed 5 children?s records and 6 staff records on-site. This inspection included document review, tour of the facility, interviews, observations and measurements.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 9/16/2024. POC submitted after this date will not appear on the public website

Standard #: 22.1-289.011-F Description: Based on observation and interview, the licensee did not ensure that the license and any other documents required by the Superintendent are posted in a conspicuous place on the licensed premises.

Based on a review of 6 records, the licensee did not ensure to request a search of the central registry, prior to employment, for staff hired after 7/1/2024.

Standard #: 8VAC20-780-280-B Description: Based on observation, the licensee did not ensure that hazardous substances such as cleaning materials, insecticides, and pesticides are kept in a locked place using a safe locking method that prevents access by children.
Evidence:
There were 3 cleaning products located in an unsecured upper cabinet in the 3 year old classroom where 8 children were in care with 2 staff at approximately 9:10 a.m.
The cleaning products each contained a warning label which stated "keep out of reach of children" along with additional warnings to include "get medical advice or attention" and "call poison control".Plan of Correction: Not available online. Contact Inspector for more information.
Standard #: 8VAC20-780-330-B Description: Based on measurements taken during he inspection on 8/30/2024, the licensee did not ensure that where play equipment is provided, resilient surfacing complies with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99 as shown in Figures 2 (Compressed Loose Fill Synthetic Materials Depth Chart) and 3 (Use Zones for Equipment) on pages 6-7 of the National Program for Playground Safety's "Selecting Playground Surface Materials: Selecting the Best Surface Material for Your Playground," February 2004, and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles. Fall zones are defined as the area underneath and surrounding equipment that requires a resilient surface.
Evidence:
On the outdoor play area, a Merry-Go-Cycle and a spring mounted bus, were observed with overlapping fall zones measuring 9 feet 8 inches between the two.

Based on observation and interview, the licensee did not ensure that when children are in ongoing mixed age groups, the staff-to-children ratio and group size applicable to the youngest child in the group are applied to the entire group.
Evidence:
The inspector observed 10 children, ages 5 months to 2 years old, in care with 2 staff at approximately 8:50 a.m. on 8/30/2024.
Staff confirmed the ages of the children in care and stated that children normally combine first thing in the morning until additional staff arrive and the children are split into to their age-specific classrooms.
The ratio applicable to the youngest child in the group is 1 staff for every 4 infants in care.Plan of Correction: Not available online. Contact Inspector for more information.
