Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated and completed on 9/9/2024. The on-site inspection began at 10:50 am and ended at 12:45 pm. The inspector reviewed compliance in the areas listed above. There were 75 children present and 16 staff. The inspector reviewed 7 children?s records and 5 staff records on-site. This inspection included document review, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-M
Description: The center is required to keep a current list of all known allergies, sensitivities, and dietary restrictions in each room or area where children are present. The list must be dated and kept confidential. The lists in the toddler 2 and toddler 3 rooms were posted in plain sight.

Plan of Correction: Fixed during inspection.

Standard #: 8VAC20-780-60-A
Description: Each center shall maintain and keep at the center a separate record for each child enrolled that contains all of the required information. The records for Child #3, #4, and #5, were missing the first date of attendance.

Plan of Correction: Start dates will be added today.

Standard #: 8VAC20-780-60-A-8
Description: A written care plan is required for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction. Child #3 has a diagnosed food allergy and did not have a written care plan in their file.

Plan of Correction: Working with the parent to get it taken care of today.
