Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated and completed on September 16, 2024. The on-site inspection began at 10:00 AM and ended at 1:14 PM. The inspector reviewed compliance in the areas listed above. There were 89 children present and 23 staff. The inspector reviewed 8 children?s records and 6 staff records on-site. This inspection included document review, tour of the facility, interviews, and observations. The information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the child day center failed to request an out-of-state Criminal history Records Request prior to date of employment.
Evidence:
1. The record for Staff #1 (DOH 8/12/24) out-of-state criminal record request was dated 8/22/24.
2. The record for Staff #2 (DOH 8/5/24) did not have documentation of an out-of-state criminal record request was submitted.
3. The center director acknowledged the out-of-state criminal record request was not requested.

Plan of Correction: I will ensure the out-of-state criminal history search request is completed prior to the date of employment even for the states that will not provide the requested information.

Standard #: 8VAC20-780-40-M
Description: Based on observation and interview, the current written list of all children's allergies, sensitivities, and dietary restrictions was not dated.
Evidence:
1. The current written list of all children's allergies, sensitivities, and dietary restrictions did not have a date on the list.
2. The center director confirmed the date is not printed on the list.

Plan of Correction: I didn't realize the date was not on the list when I print it for the classrooms. I will add the date now. I update the list in August or if we enroll new students who need to be listed.
Violation corrected during the inspection.

Standard #: 8VAC20-780-440-L
Description: Based on observation, pillows and filled comforters were used by children under two years of age.
Evidence: There were 3 children sleeping on mats in the Buttercups classroom (Birth to 16 months) that were using a nap mat that has a quilted blanket and pillow attached.

Plan of Correction: The nap mat will be sent home today and we will ask the parents to bring in a blanket. We already have sheets for the cots.

Standard #: 8VAC20-780-500-B
Description: Based on observations, disposable diapers shall be disposed in a leakproof or plastic-lined storage system that is either foot-operated or used in such a way that neither the staff member's hand nor the soiled diaper touches an exterior surface of the storage system during disposal.
Evidence: The disposable diaper storage system was not foot-operated and could not be used without the staff's hand touching the exterior surface of the storage system.

Plan of Correction: We will use the small foot-pedal trash can but I will order a new container for the diapers.
