Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated on 9/10/2024 and completed on 9/11/2024, as a part of the licensure period. The on-site inspection began at 11:45am and ended at 1:56pm. The inspector reviewed compliance in the areas listed above. There were 37 children present and eight staff. The inspector reviewed five children?s records and five staff records on-site. Additional documentation was reviewed electronically on 9/11/2024. This inspection included document review, tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 09/24/2024. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of five staff records and interviews, the center did not obtain a required out-of-state background check from any state in which one staff member had resided in the preceding five years within the required timeframe.

Evidence: The record of Staff #5, date of employment 08/29/23, indicated the staff had resided in two states outside of Virginia within the last five years. The results of the criminal history record information check for State A were obtained on 10/27/23. The results of the criminal history record information check for State B were obtained on 11/27/23.

The out-of-state criminal history record information check is required to be obtained prior to employment.

Plan of Correction: Per the Center: "Our process for hiring now includes obtaining authorization for and submitting a request for out of state criminal record checks for prospective new hires for any state they have resided within the last five years before their date of hire."

Standard #: 8VAC20-780-510-G
Description: Based on observation and interviews, the center did not ensure a medication for one child was labeled with the child's name, the dosage amount, and the time or times to be given.

Evidence: A prescription medication was observed on site for Child #1. The medication was missing the label which contains the child's name, the dosage amount, and the time or times to be given.

During interview, it was reported the center did not have the medication label on site.

Plan of Correction: Per the Center: "Parent provided a prescription label with child?s name, the dosage
amount, administration frequency/ instructions on it, it was attached to the medication on 9/18/24. Moving forward we will ensure that all medications have this label affixed with child's name, the dosage amount, and the time or times to be
given before accepting them in our center."
