Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated on 09/12/24 and completed on 09/13/24, as a part of the licensure period. The on-site inspection began at 11:45am and ended at 2:10pm. The inspector reviewed compliance in the areas listed above. There were 34 children present and nine staff. The inspector reviewed five children?s records and five staff records on-site. Additional documentation was reviewed electronically on 09/13/24. This inspection included document review, tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-770-60-B
Description: The center is required to obtain a completed sworn statement prior to the employee's first day of employment.

The record of Staff #4, who has been employed at the center for over five months, did not have a completed sworn statement.

Plan of Correction: The missing sworn statement was requested to be completed by 9/17/2024. In the future, staff will complete a sworn statement at the time of employment.

Standard #: 8VAC20-770-60-C-2
Description: For staff hired before July 1, 2024, providers must obtain the results of a central registry search for an employee, within 30 days of employment.

The central registry search results in the record of Staff #1, who is currently employed, was dated three months after their first day of employment.

The central registry search results in the record of Staff #2, who is currently employed, was dated two months after their first day of employment.

Staff #4 did not have central registry search results during the inspection and has been employed for over five months.

Plan of Correction: Management will ensure to verify communication for documentation of timeliness moving forward.

Standard #: 8VAC20-780-160-A
Description: Documentation of a negative tuberculosis (TB) screening must be submitted at the time of employment, before coming into contact with children, and shall have been completed within the last 30 days of the date of employment.

The TB screening in the record of Staff #3 was completed two days after the date of employment.

Staff #4 has been employed for over five months and does not have documentation of a negative TB screening.

Plan of Correction: The missing TB was obtained on 09/17/24.

Standard #: 8VAC20-780-160-C
Description: A tuberculosis (TB) screening is required every two years from the last screening.

Staff #2's updated TB screening was due three months ago. The updated screening has not yet been completed.

Plan of Correction: The repeat TB was obtained on 09/18/24.

Standard #: 8VAC20-780-70
Description: Documentation of at least 2 references to character, reputation, and competency are to be checked prior to employment.

Staff #1, who has been actively working at the center for the past 3 months, did not have any completed reference verifications on file.

Plan of Correction: The missing references were obtained on 09/18/24.

Standard #: 8VAC20-780-240-A
Description: Staff are to complete the VDOE sponsored online orientation course within 90 days of employment.

Staff #2 completed the course five months late.

Staff #4 has not completed the course and has been employed for over five months.

Plan of Correction: The missing DOE orientation will be completed no later than 9/27/24.

Standard #: 8VAC20-780-530-A
Description: At least one staff in each classroom or area where children are present shall have current certification in both CPR and first aid.

Staff #3 was alone with a group of seven, three-year-old children and was not certified in CPR or first aid.

Plan of Correction: Staff #3 will be accompanied by another staff member with current CPR and first aid certification. Staff #3 is signed up for a class on 10/12/24.
