22.1 BACKGROUND CHECKS, CODE, CARBON MONOXIDE

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated and completed on 10/09/2024. The onsite inspection began at 2:45 pm and ended at 4:15 pm. The inspector reviewed compliance in the areas listed above. There were 72 children and 8 staff. The inspector reviewed 7 children?s records; staff records will be reviewed at the administrative office on a later date.

The inspection included document review, tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-60-A-8
Description: A written care plan is required for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction.

Child 6, who has been enrolled for 2 months, has a diagnosed food allergy and did not have a written care plan in their file.

Plan of Correction: Will give the parent the form today.

Standard #: 8VAC20-780-80-A
Description: For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

The attendance is not taken for each group of children and the attendance record does not document the departure as it occurs.

Plan of Correction: Will give each group their own attendance record.

Standard #: 8VAC20-780-280-G
Description: When hazardous substances are not kept in the original container the substitute container shall clearly indicate the contents.

There were two unlabeled plastic spray bottles in the metal storage cabinet.

Plan of Correction: Will label the containers.

Standard #: 8VAC20-780-510-L
Description: REPEAT VIOLATION

Medication shall be kept in a locked place using a safe locking method that prevents access by children.

Medication 1 was in the child?s unlocked backpack.

Plan of Correction: Will order a locked bag.
