Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site focused inspection was initiated on October 10, 2024 and completed on October 10, 2024 as a part of an Intensive Plan of Correction (IPOC). The Department requested that the provider complete an IPOC as result of the last inspection related to staff records, tuberculosis screening for staff, staff-to-children ratio, medication, and background checks. The on-site inspection began at 1:25 pm and ended at 2:45 pm. The inspector reviewed compliance in the areas listed above. There were 39 children present and six staff. The inspector reviewed no children's records and two staff records on-site.
This inspection included document review, tour of the facility, interviews, and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on October 22, 2024. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 22.1-289.035-B-1
Description: The center is required to obtain a completed sworn statement prior to the employee's first day of employment.

The sworn statement for Staff #2, who is currently working, was dated 10 days after their first day of employment.

Plan of Correction: Per the director: Sworn statements will be completed on or before hire date.

Standard #: 8VAC20-770-40-D-6
Description: A facility must not accept a required criminal history record report or a central registry finding from an applicant, required to obtain background checks that is dated more than 90 days prior to the date of employment.

Staff #2, employed for six weeks and currently working, had a central registry background check dated 10 months prior to the date of employment.

Plan of Correction: Per the director: If a potential employee doesn't come on board within a certain amount of time, the background and tb will be processed again.

Standard #: 8VAC20-780-160-A
Description: Documentation of a negative tuberculosis (TB) screening must be submitted at the time of employment, before coming into contact with children, and shall have been completed within the last 30 days of the date of employment.

Staff #2, who had been actively working for six weeks had a TB dated nine months prior to date of employment.

Plan of Correction: Per the director: potential employees TB will be completed no more than 30 days prior to employment.

Standard #: 8VAC20-780-70
Description: Repeat
Documentation of at least 2 references to character, reputation, and competency are to be checked prior to employment.

Staff #1, who has been actively working for six weeks, had one reference dated the day after employment.

Plan of Correction: Per the director: references will be contacted prior to employment.

Standard #: 8VAC20-780-240-B
Description: Staff shall complete orientation training in subsection C of this section prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

Staff #2, completed orientation training 10 days after the date of employment.

Plan of Correction: Per the director: Orientation will be completed prior to start date.
