Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was conducted on 10/15/24 from 10:00 am to 12:20 pm. The inspector reviewed compliance in the areas listed above. There were 64 children present and 12 staff. The inspector reviewed 4 children?s records and 4 staff records on-site.
This inspection included document review, tour of the facility and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 10/23/24. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 8VAC20-780-70
Description: Staff records with complete information shall be kept for each staff person.

Staff # 1 and Staff # 2's records were missing the date of employment.

Plan of Correction: Records were corrected and updated on October 15, 2024.

Standard #: 8VAC20-780-210-A
Description: Program leaders shall be at least 18 years of age, have fulfilled a high school program completion or the equivalent, and meet the requirements as listed in the licensing regulations.
1. Staff # 1 stated that Staff # 3 and Staff # 5 were program leads in their respective classrooms.
2. Both staff had diplomas in another language and no other supporting documents to demonstrate they met the requirements for a program lead.

Standard #: 8VAC20-780-240-A
Description: The Virginia Department of Education-sponsored orientation course shall be completed within 90 calendar days of employment.

Staff # 1 and Staff # 2 have been both employed at the center for over 90 days. Neither staff has completed the department's preservice training.

Plan of Correction: Preservice training is scheduled to be completed by October 23, 2024.

Standard #: 8VAC20-780-240-C
Description: Orientation training shall be appropriate to the age of the children in care and include all of the facility specific topics.

Documentation of Staff # 1 and Staff # 2's orientation showed that it did not include the following topics: abusive head trauma, sudden infant death syndrome, shaken baby syndrome, use of safe sleep practices and procedures to cope with crying babies or distraught children.

Plan of Correction: New staff orientation record documents were edited to the staff member's files where it shows that the staff members completed the training on October 15, 2024.

Standard #: 8VAC20-780-340-F
Description: Children under 10 years of age always shall be within actual sight and sound supervision of staff.

1. At approximately 10:30 am, Child # 1 from Staff # 3's classroom (4-5 year old) was seen using the bathroom located in the main hallway of the center.
2. Child # 1 was alone in the bathroom with no staff supervising. Staff # 3 was in her classroom with the rest of the children.
3. At approximately 11:35 am, Staff # 4 had taken 7 children (4-5 yr. old) to the bathroom located in the main hallway of the center.
4. Staff # 4 had left three children in the classroom alone and unsupervised. The classroom is not within sight of the bathroom.
5. Additionally, children from Staff # 4's classroom were observed leaving the classroom and going back and forth from the classroom to the bathroom to wash their art cups without any supervision.

Plan of Correction: All teachers were reminded about the school policy that they need to ask a school assistant to accompany the child to the bathroom and back to the classroom if a child needs to go to the bathroom during class time. In addition to the reminder email was sent out to the teachers on 10/21/24.
