8VAC20-780 Special Care Provisions and Emergencies
During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical assistance was provided and standards reviewed in the following areas: 8VAC20-780-330 B Play areas, 8VAC20-780-550 P Procedures for emergencies, 8VAC20-780-210. Program leader qualifications.
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced monitoring inspection was initiated and completed on 10/22/24 in response to a self-report received by the licensing office on 9/27/24 relating to physical plant and special care provisions and emergencies. The inspector reviewed six children?s records and five staff records on-site (10/22/24) and electronically on 10/16/24 and 10/30/2024. This inspection included document review, a tour of the facility, interviews, observations, and measurements. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 11/7/24. A POC submitted after this date will not appear on the public website.

Standard #: 8VAC20-780-330-B Description: Where playground equipment is provided, resilient surfacing shall comply with minimum safety standards (at least six inches of shredded rubber for equipment 7 feet high).
At the time of the inspection, there was four inches of resilient surfacing measured in the fall zone of the monkey bars where a serious injury of a child occurred on 9/25/24.Plan of Correction: The violation (780-330 B) will be appealed by the center.
Standard #: 8VAC20-780-550-P Description: The center shall maintain a written record of children's minor injuries in which entries are made the day of occurrence. The record shall include all the required information.
The injury report for a serious injury that occurred on 9/25/24 did not include any future action to prevent recurrence of the injury, which is required.Plan of Correction: Staff were reminded that all sections of the injury form must be fully completed. Additionally, it was emphasized that there is always a preventive measure that can
be implemented, and to consult with administration even when all safety procedures have been followed.
