Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site renewal inspection was initiated on and completed on 10/16/2024. The on-site inspection began at (time) and ended at (time). The inspector reviewed compliance in the areas listed above. There were 60 children present and 15 staff. The inspector reviewed 6 children?s records and 6 staff records on-site. This inspection included document review, a tour of the facility, interviews and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289-036-B-4
Description: The child day center shall obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which each individual has resided in the preceding five years.

Staff #6 currently resides outside of the state of Virginia part-time. The child day center has not obtained an out of state criminal history record, sex offender registry check and a search of the child abuse and neglect registry for staff #6.

Plan of Correction: We will start the process today to obtain the out of state background checks. Update: all missing background checks have been received.

Standard #: 22.1-289.036-A
Description: Every agent of an applicant for licensure as a child day center shall undergo a background check search every five years.

The central registry search, criminal history search and sworn disclosure statement for staff #5 have been expired for approximately 12 months.

Plan of Correction: We did not realize that board officers needed to repeat background checks if they are not on-site. We will begin the process today to obtain the updated background checks. Update: all missing background checks have been received.
