During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Health Inspections - In collaboration with the Virginia Department of Health (VDH), the VDOE is reminding providers that the Food Establishment Health form is only used by VDH when determining compliance with food regulations. A Report of Environmental Sanitation Inspection form should be used for environmental health inspections and determining compliance with non-food related health requirements such as water supply and sewage disposal. The Report of Environmental Sanitation Inspection form can be found on the Department?s website.

Comments:
An unannounced, on-site monitoring inspection was initiated and completed on 10/16/2024. The on-site inspection began at 3:55 p.m. and ended at 5:42 p.m. The inspector reviewed compliance in the areas listed above. There were 45 children present and 5 staff. The inspector reviewed 5 children?s records and 5 staff records electronically on 11/5/2024.

This inspection included document review, tour of the facility, interviews and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 11/11/2024. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 22.1-289.035-B-3
Description: The center must request a search of the central registry prior to the employee's first day of employment. Staff #1, who had been employed for more than 6 weeks and was working with children at the time of inspection, did not have documentation that a central registry search had been requested.

Standard #: 22.1-289.035-B-4
Description: The center is required to obtain background checks from any state in which the individual has resided in the preceding five years.
The record for staff #3, who has been employed for more than 1 month and was working with children at the time of the inspection, did not contain documentation of requesting a central registry check from one state and no documentation of requesting a sex offender search or for the same state.

Standard #: 8VAC20-780-70
Description: (Repeat Violation) Documentation to include date of employment or volunteering and name, address, and telephone number of a person to be notified in an emergency, shall be kept for each staff person.
Staff #2, whose length of employment is undetermined, was working with children at the time of inspection and did not have a date of employment or volunteering nor the name, address, and telephone number of a person to be notified in an emergency on record.

Standard #: 8VAC20-780-80-A
Description: For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs. At approximately 4:40 pm. on 10/10/2024, there were 45 children present in the multipurpose room but an attendance had not been recorded.

Standard #: 8VAC20-780-240-B
Description: Staff is required to complete a center specific orientation training prior to working alone with children and no later than seven days of the date of assuming job responsibilities.
Staff #4, whose date of employment was undetermined, was working with children during he inspection on 10/16/2024 did not have documentation available to demonstrate that orientation training had been completed when staff records were submitted for review 7 days later.

Standard #: 8VAC20-780-245-L
Description: There shall always be at least one staff member on duty who has obtained within the last three years instruction in performing the daily health observation of children. None of the records for the 5 staff present on10/16/2024 contained documentation to demonstrate that they had completed instruction in performing the daily health observation of children.
