During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

An unannounced monitoring inspection was initiated on 10/25/24 and completed on 11/18/24 with a local agency in response to a self-report received by the licensing office on 10/21/24 relating to Forbidden Actions. The inspector reviewed 1 child record and 1 staff record electronically on 11/1/24. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 1/14/25. A POC submitted after this date will not appear on the public website.

Standard #: 63.2-1509-A Description: The Center is required to report a suspected incident of child abuse or neglect to Child Protective Services immediately.
? Staff #2 stated that the parent of Child #1 told them on 7/25/24 that their child had reported that Staff #1 had punched them and grabbed their face the previous day.
? Staff #2 failed to report the suspected abuse to Child Protective Services (CPS) until 10/21/24 when the parents of Child #1 viewed video footage at the center with Staff #2 and demanded it be reported while they were present at the Center.
? When Staff #2 initially reported the abuse to CPS, they reported only the incident where Staff #1 punched and grabbed Child #1 that occurred the afternoon of 7/24/24, but failed to report the incident on the morning of 7/24/24 involving the rough handling of Child #1 when Staff #1 had forcefully grabbed Child #1 by their arm to complete an assignment.
? Staff #2 confirmed when asked about the earlier incident that they had known about the incident but had not reported it.Plan of Correction: All staff members have been trained on mandated reporter policies and guidelines.
Standard #: 8VAC20-780-400-B Description: The Center is required to use behavioral guidance that is constructive in nature, age and stage appropriate, or intended to redirect a child to appropriate behavior and resolve conflicts.
Evidence:
On 7/24/24 at approximately 4:21pm, Staff #1 grabbed Child #1?s face tightly with their hand and turned the child?s face abruptly to face them. Then Staff #1 began speaking directly into the child?s face. Staff #1 stated that this was how they were trying to redirect the child?s behavior to re-engage in the activity and make them finish their assignments.Plan of Correction: All staff members have been retrained on positive guidance.
Standard #: 8VAC20-780-410-1 Description: The Center is required to ensure that the forbidden actions of physical punishment, striking a child, and roughly handling a child does not occur.
? On 7/24/24 at approximately 9:08am, Child #1 had not finished their coloring assignment. Staff #1 became frustrated and roughly grabbed Child #1 by their right wrist and hand and began using Child #1?s hand within their own hand to forcefully complete the activity by scribbling furiously on a page placed on the table. When they finished, Staff #1 roughly grabbed Child #1 by the left arm and forcefully lead them over to a table to clean up writing utensils.
? On 7/24/24 at approximately 4:21pm, Child #1 was hopping on the floor tiles close to the table where Staff #1 was seated with 5 other children. Staff #1 called Child #1 over to them. Then Staff #1 punched Child #1 twice in the stomach and hip area and the child?s body was seen shifting backwards from the force. Next, Staff #1 struck Child #1 on the shoulder, then grabbed the child?s forearm roughly several times while speaking to them. Child #1 sobbed when they were interviewed on 10/25/24 about this incident.Plan of Correction: Staff #1 has been terminated and is not allowed back in the center. All other staff members have been retrained on recognizing and reporting child abuse.
