Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated on 11/15/2024 and completed on 11/15/2024. The on-site inspection began at 3:15 pm and ended at 5:00 pm. The staff records were reviewed on 11/12/2024. The inspector reviewed compliance in the areas listed above. There were 71children present and seven staff. The inspector reviewed four children?s records and four staff records on-site. This inspection included: document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-160-A
Description: Each staff member shall submit documentation of a negative TB screening at the time of employment. Staff 1 was employed approximately one month ago and there is no documentation of TB screening in their file.
Staff 2 was employed for approximately six months before TB screening documentation was obtained.

Plan of Correction: The office manager will make arrangements for TB screening for staff 1 immediately, and from now on, will make sure TB screening results are obtained prior to employment.

Standard #: 8VAC20-780-510-G
Description: Medication shall be labeled with the child?s name, name of the medication, dosage amount, and time to be given. An unlabeled bottle of diphenhydramine gummies was in the medication box.

Plan of Correction: The medication was removed during the inspection and locked in a non-licensed child day care part of the building. From now on, staff will check to make sure there are no unlabeled medications in the center.

Standard #: 8VAC20-780-510-P
Description: When authorization for medication expires, it needs to be picked up within 14 days or be disposed of if the parent does not renew the authorization. Authorization to administer medication to Child 2 expired approximately three months previously and the medication was in the medication storage box.

Plan of Correction: The director will have the parent get new authorization for the medication.
