Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, on-site monitoring inspection was initiated and completed on 12/16/2024. The on-site inspection began at 11:40am and ended at 1:15pm. The inspector reviewed compliance in the areas listed above. There were 130 children present and 25 staff. The inspector reviewed 10 children?s records and 4 staff records on-site on 12/16/2024. This inspection included: document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Standard #: 22.1-289.035-B-4 Description: The Child day center is required to obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which an individual (employee) has resided in the preceding five years.
Staff #1 did not have results of an out-of-state Central registry check for a state in which the employee has lived in the preceding 5 years and has been employed for 3 months. Staff #3 did not have the results of an out-of-state Central Registry check and out-of-state Criminal History check for two states in which the employee has lived in the preceding 5 years. Staff #3 has been employed for 3 months.Plan of Correction: We will complete and mail out the required out-of-state background checks for Staff #3. The Central registry background check for Staff #1 was already mailed out prior to the inspection, however, results have not been received yet. We will follow-up in the required timeframe.
