During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age
children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the
program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site monitoring inspection was initiated on 11/25/2024 and completed on 11/25/2024, as a part of the licensure period. The on-site inspection began at 9:50am and ended at 12:00pm. The inspector reviewed compliance in the areas listed above. There were 55 children present and 11 staff. The inspector reviewed five children?s records and five staff records on-site. This inspection included document review, tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: The center is required to obtain background checks from any state in which the individual has resided in the preceding five years.

Staff #2, employed for more than four months, did not have documentation of requesting a central registry check from one state.

Staff #3, employed for more than 17 months, did not have documentation of requesting a central registry check from one state.

Plan of Correction: The missing background checks will be requested from each state.

Standard #: 8VAC20-770-60-C-2
Description: For staff hired before July 1, 2024, providers must obtain the results of a central registry search within 30 days of employment.

The central registry search results in the record of Staff #3, who is currently employed, was obtained five months after the date of employment.

Plan of Correction: Corrected.

Standard #: 8VAC20-780-70
Description: (Repeat Violation) Documentation of at least 2 references to character, reputation, and competency are to be checked prior to employment, if a reference is taken over the telephone it shall include the required information.

The references in the records of Staff #1, Staff #3, and Staff #4, were checked over the telephone, but the documentation did not include the dates of contact. For Staff #4, they did not include the signature of the person making the call. Staff #1 and Staff #3 have been employed for more than 17 months, and Staff #4 has been employed for 13 days.

The records of Staff #2, employed for more than five months, and Staff #5, employed for eight days, did not have any completed reference verifications on file.

Plan of Correction: The center will document references taken over the telephone on a form that includes all the required information.

Standard #: 8VAC20-780-240-A
Description: Staff are to complete the VDOE sponsored online orientation course within 90 days of employment.

Staff #3, employed for more than 17 months, did not have documentation that they have completed the course.

Plan of Correction: Documentation will be obtained from the staff member and filed. The DOE orientation will be completed within 90 days of employment moving forward.

Standard #: 8VAC20-780-550-D
Description: (Repeat Violation) The center shall implement a monthly practice evacuation drill.

An evacuation drill was not practiced in September 2024.

Plan of Correction: The emergency evacuation drills will be practiced monthly moving forward.
