During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements.

Comments:
An unannounced inspection was initiated and completed on January 21, 2025, in response to a complaint received by the licensing office on December 11, 2024, relating to allegations of staffing and supervision, and care and protection. This inspection included interviews, observation and document review.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on February 13, 2025. A POC submitted after this date will not appear on the public website.

The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

1. On December 2, 2024, and December 9, 2024, a child was released to a person that was not listed on the child?s release authorization form. The center?s policy states that ?Only persons designated on the Henrico PAL Child Release Authorization Form for your child will be permitted to pick-up. Staff members will request photo identification. Please be aware that we do this for the safety and protection of the children in our programs. Henrico PAL will not release a child to anyone not listed on a signed Henrico PAL Child Release Authorization form?

2. Staff#1 stated that staff did not request photo identification from the person picking up a child before the child was released.

When staff are supervising children, they shall always ensure their care, protection, and guidance.

1. On December 9, 2024, a parent witnessed children between the in care watching a movie that was rated PG13 that was inappropriate for children to watch. The children that were watching the movies range in age from 5 years to 10 years old.
2. Staff #1 confirmed that staff had allowed the children to watch the movie the movie Beetlejuice. Staff #1 stated that staff wasn?t aware that the movie was inappropriate for the children to watch because most of the children stated that they had already seen the movie.
