22.1 BACKGROUND CHECKS, CODE, CARBON MONOXIDE

Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, onsite renewal inspection was initiated on 02/05/2025 and completed on 02/07/2025. The on-site inspection began at 3:30 pm and ended at 4:35 pm. The inspector reviewed compliance in the areas listed above. There were 16 children present and 2 staff. The inspector reviewed 5 children?s records during the on-site inspection and 2 staff records and 5 applicant records during a virtual inspection on 02/07/2025.
The inspection included: document review, tour of the facility, interviews, and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Standard #: 8VAC20-780-160-C Description: A tuberculosis (TB) screening is required every two years from the last screening.
The updated TB screening for Staff 2 was 2 weeks overdue.Plan of Correction: The staff has an appointment to go on Monday.
Standard #: 8VAC20-780-40-E Description: The center shall maintain compliance with the center?s own policies and procedures that are required by the standards.
The center?s procedures for accounting for all children states that when children are not present, staff will contact the school, parent or emergency contact to ensure that all children are accounted for.
Child 6 (9 years old) was not present on 02/05/2025. The child?s parent arrived to pick up the child. It was determined that the child rode the public-school bus home rather than staying for after school care. The staff had not contacted the school or the parent to ensure that Child 6 was accounted for.Plan of Correction: Spoke with staff. The staff will check with the office each day when children do not show up for care.
Standard #: 8VAC20-780-540-E Description: One working, battery-operated radio shall be maintained in each building used by children.
The battery-operated radio on-site did not work.Plan of Correction: Sent new batteries to the site.
