Comments:
An unannounced inspection was initiated on 02/18/2025 and completed on 02/18/2025 in response to a complaint received by the licensing office on 01/16/2025 relating to allegations of Behavioral Guidance. The inspector reviewed 5 children?s records and 5 staff records. This inspection included: document review, tour of the facility, interviews, observations and measurements. The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Description: Children under 10 years of age shall always be within actual sight and sound supervision of staff.

During the video footage from 2/14/25 viewed by the inspector and director on 2/18/25, ten three-year-old children were unsupervised on two separate occasions for approximately 2 mins each occasion as staff #1 left the room.

Description: Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

For several minutes 2 children were playing with the trash can and the back door while 2 other children were pushing each other. Staff #2 did not acknowledge or redirect their behaviors.

Staff #1 did not use constructive, or stage appropriate behavioral guidance intended to redirect children to appropriate behavior and resolve conflict when she placed three-year-old children in time-out because they did not dance during an activity. Staff #1 sternly said the following to the children that were put in time-out: "Go ahead and test me? and "Not dancing because you don't like the music is silly."

Staff used directives in a harsh tone instead of redirecting children to appropriate behavior. Staff #1 used her hand on a child?s head and sternly said, "Move? and "No, don't start" to child sitting against the wall. Staff #2 said "We're not going to have fun, you understand?" and "go sit down all of you" Staff #3 told four-year-old children "don't shout, come here, you yell again and you're out of here

Description: When time out is used as a behavior guidance technique it should be used sparingly and shall not exceed one minute for each year of the child's age.

Video footage dated 2/14/2025 of the three-year-old classroom was viewed by inspector and Program Director on 2/18/25.

Video footage from 2/14/25 confirmed that staff #1 did not use time out sparingly and only one minute for each year of the child?s age. Child #1 a three-year-old was in time out for approximately 25 minutes.

At several points during the period of observation there were 5-6 three-year-old children out of the 10 in this classroom in time out
at the same time.
