63.2 Child Abuse & Neglect

During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Comments:
An unannounced monitoring inspection was initiated on 1/29/2025 with outside agencies and completed on 2/19/2025 in response to a self-report received by the licensing office on 1/24/2025 relating to the care, protection, and guidance of children. The inspector reviewed eleven children?s records and six staff records on site and electronically on 2/12/2025 and 2/18/2025.

This inspection included document review (attendance records, policies and procedures, medical records/photos, staff credentials and staff training) tour of the facility, interviews, and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program. Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five business days from today, which will be the close of business on 3/03/2025. A POC submitted after this date will not appear on the public website.

Violations:
Standard #: 8VAC20-780-40-E
Description: The operational responsibilities of the licensee shall include ensuring that the
center's activities, services, and facilities are maintained in compliance with these
standards and the center's own policies and procedures that are required by these
standards. The center?s policy for positive child guidance states that staff are to, ?praise children for good behavior and re-direct children?s attention and engage them in a positive activity." Staff # 2 stated in an interview on 2/04/25, that Child #1 (age 18 months) would routinely take off his shoes and socks. On 01/22/2025, Child #1 took of his shoes and socks. Staff #2 wrapped packaging tape around the shoes of Child #1 to prevent Child #1 from being able to remove them.

Plan of Correction: All staff will participate in an engaging conversation at the next staff meeting while reviewing the Employee Handbook to ensure a complete understanding of our policies and procedures. All staff will take the "Excellence in Action" training which focuses on strengthening teaching skills and gaining confidence in the classroom with a growth mindset. Center Director and Assistant Director will conduct formal observations reviewing classroom behaviors including professionalism, relationships, classroom environment, and curriculum and development. Program Specialists will conduct ongoing informal, announced and unannounced daily visits to classrooms to monitor for licensing compliance, classroom management, and interactions with children and co-workers.

Standard #: 8VAC20-780-340-A
Description: When staff are supervising children, they shall always ensure their care, protection, and guidance. On 1/22/2025, Staff #2 wrapped packing tape around the shoes of Child #1 (age 18 months) because the child kept taking his shoes and socks off. The tops of the child?s feet were later observed to be red and swollen which required outside medical care.

Plan of Correction: All staff will take the 'Active Supervision Everywhere" training which focuses on exploring active supervision tools and strategies to keep children safe and engaged. Center Director and Assistant Director will conduct formal observations reviewing classroom behaviors including professionalism, relationships, classroom environment, and curriculum and development. Program Specialists will conduct ongoing informal, announced and unannounced daily visits to classrooms to monitor for licensing compliance, classroom management, and interactions with children and co-workers.

Standard #: 8VAC20-780-400-B
Description: Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior. Staff #2 did not provide constructive, age and stage appropriate behavior guidance on 1/22/2025 when trying to get Child #1 (age 18 months) to stop taking off his shoes and socks. Rather than redirecting the child in a constructive manner, Staff #2 wrapped packing tape around the outside of each shoe, over the Velcro fasteners and under the soles to prevent the child from being able to take them off.

Plan of Correction: All staff will take "Positive Guidance" training which focuses on relationship building and modeling positive behaviors and language in the classroom. All staff will take the "Building Relationships with Children and Youth Who Challenge Us" through Better Kid Care. Center Director and Assistant Director will conduct formal observations reviewing classroom behaviors including professionalism, relationships, classroom environment, and curriculum and development. Program Specialists will conduct ongoing informal, announced and unannounced daily visits to classrooms to monitor for licensing compliance, classroom management, and interactions with children and co-workers.
