8VAC20-780 Programs. 63.2 Child Abuse & Neglect During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation

Comments:

An unannounced inspection was initiated on July 30 2025 and completed on August 6 2025 in response to a complaint received by the licensing office on June 26 2025 relating to allegations of Forbidden Actions and Behavioral Guidance. The Department requested that the provider complete an Intensive Plan of Correction as result of the last inspection related to Forbidden Actions and Behavioral Guidance. The inspector reviewed 3 children?s records and 2 staff records. This inspection included a document review, tour of the facility, interviews, and observations. The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law, and the violations are documented on the violation notice issued to the program. Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five business days from today, which will be the close of business on August 29 2025. A POC submitted after this date will not appear on the public website.

Description:	When time out is used as a behavior guidance technique, It shall be used sparingly and shall not exceed one minute for each year of the child's age; The licensing inspector observed Staff place Child #2, 2 years 1 month, into a child care feeder chair for 3 minutes. The center exceeded the one minute for each year of the child's age regulation.
Plan of Correction:	Staff were re-educated on timeout procedures appropriate for each child's age and developmental stage. The creation of a safe space was implemented in each classroom with staff instructed on effective use of a calming corner for emotional development.

Description:	The following actions or threats thereof are forbidden: Enclosure in a small confined space or any space that the child cannot freely exit himself; however, this does not apply to the use of equipment such as high chairs, when used with children preschool age or younger for their intended purpose. The licensing inspector was emailed a video of a child in a child care feeding chair. Child #1 was observed strapped to the chair without the feeding tray attached. The child could not freely get out of the seat. The child was observed to be distraught, visibly upset, and crying. The child was observed rocking and trying to actively remove themself from the chair. During the 35 second video, no staff can be seen attending to the child. During the August 6 2025 inspection, the licensing inspector observed Child #2, 2 years 1 month, being placed into a child care feeding chair as a timeout for not napping. The child was strapped into the chair with no tray attached for 3 minutes. During the August 6 2025 inspection, the licensing inspector observed Child #3, 1 year and 11 months of age, lying on their cot for naptime. Staff #1 place their body over the child and placed their hand on the blanket close to Child #3's body. This limited the child's ability to move or roll over. During the August 6 2025 inspection, the licensing inspector observed Child #4, 1 year and 8 months old, on a cot for nap time. Child #4 was observed squirming, rolling over, and moving. Staff #2 was observed picking up Child #4 and placing them back down on the cot. Staff #2 was observed holding Child #4's legs and hips to prevent further movement. The inspector then observed Staff #2 put their hand on the child's bottom to restrict the child's movement.
Plan of Correction:	Staff were reminded of the safe nap procedures and policies. The school will prepare a separate classroom with staff supervision for students who choose not to nap, preventing them from becoming safety risks to napping students by jumping around cots or engaging in disruptive activities. Staff were re-educated on timeout procedures appropriate for each child's age and developmental stage. Booster chairs will be removed from classrooms serving children 2 years old and above. The creation of a safe space was implemented in each classroom with staff instructed on effective use of a calming corner for emotional development.
