During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Comments:
An unannounced inspection was initiated on 10/29/2025 and completed on 11/23/2025 in response to a complaint received by the licensing office on 10/14/2025 regarding allegations concerning medication and procedures for emergencies. The inspector reviewed one child?s record, and one staff record on-site. This inspection included document review tour of the facility, interviews, and observations.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 12/05/2025. A POC submitted after this date will not appear on the public website.

The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

The center did not follow the center?s Child Allergy and Child Medication Procedures. The Child Allergy Procedure stated, ?All staff members working in the kitchen must ensure they are reading the ingredient labels to minimize the risk of allergen exposure.? The Child Medication Procedures stated, ?All staff in the school should know where emergency medications are kept in each classroom.?
On 08/05/2025, staff served center provided food that contained an ingredient to which Child A (21 months old) was allergic. Child A experienced an allergic reaction. Staff #1 stated they were unaware medication was present at the center and it took several minutes to locate the medication for Child A.

Plan of Correction: A refresher will training will be given to all staff addressing medication location and who is allowed to administer medication on December 10, 2025. Safety Captain made aware of medication administration protocol and location on 10/29/2025.

When staff are supervising children, they shall always ensure their care, protection, and guidance.
On 08/05/2025, staff served food provided by the center that contained an ingredient to which Child A (21 months old) was allergic. Child A experienced an allergic reaction, with symptoms including a red and puffy face. A picture of Child A and a list of their food allergies were posted in all classrooms and the kitchen. Collateral Witness #1 had completed the center?s severe allergy packet and provided medication for possible allergic reactions. Management was unaware Child A?s had medication located at the center. It took several minutes to locate the allergy medication. The center did not contact 911. Staff #2 administered the medication without current Medication Administration Training certification. The medication log for Child A documenting specific information regarding the administered medication could not be located for review.

Plan of Correction: New management discussed allergies and ingredient lists with kitchen staff in September 2025. Follow up training for all staff regarding requirements for allergies and accurate documentation will be conducted on December 10, 2025.

The center may administer prescription medication that would normally be administered by a parent or guardian to a child provided the medication is administered by a staff member or an independent contractor who meets the requirements in 8VAC20-780-245 J.
Staff #2 administered medication to Child A on 08/05/2025. During the 10/29/2025 inspection, Staff #1 stated they did not have current Medication Administration Training certification.

Plan of Correction: New management implemented oversight of medication and medication will only be given by MAT trained staff.

On 08/05/2025, Staff #2 administered an emergency medication to Child A. The medication log for Child A documenting the specific information regarding the administered medication could not be located for review.

Description: Complaint:
A child with a diagnosed food allergy shall not be served any food identified in the written care plan required in 8VAC20-780-60 A 8.
The completed written food allergy action plan was present at the center. A food containing ingredients Child A was allergic to was served to the child on 08/05/2025. Child A had an allergic reaction.

Plan of Correction: Ensure kitchen staff, teachers, and substitutes are aware of allergy list. Management will provide additional training on December 10, 2025 to all staff about food allergens. Allergy lists will be updated as needed and monthly.
