An unannounced Code compliance inspection was conducted on September 11, 2018 from 10:20am - 1:00pm. At the time of the tour there were 85 children in care with 10 staff. The children in care ranged in age from two years - 12 years. The inspector reviewed all Code of Virginia Requirements for Religiously Exempt Child Day Programs. A sample size of 11 staff records were reviewed. The violations are listed on the violation notice and were reviewed with administrative staff at the conclusion of the inspection. The exit interview was conducted with administrative staff on 09/17/2018.
Standard #: 22VAC40-191-40-D-2 Description: Based on review of 11 current staff records it was determined that the child day center failed to ensure that all staff have a criminal history record and search of the central registry within 30 days of employment. Evidence: 1. The following staff were hired prior to the implementation of fingerprinting, January 22, 2018, and did not have a completed criminal history record on file: -staff #2 (employed June 2014) -staff #3 (employed January 2011) -staff #4- (employed November 2010) -staff #5 - (employed September 2015) -staff #6 - (employed January 2011) -staff #7 - (employed September 2010) -staff #8- (employed September 2017) -staff #9 - (employed September 2010) -staff #10 - (employed September 2015) -staff #11 - (employed August 2010) 2. None of the 11 staff current staff records reviewed contained a search of the central registry. 3. Administrative staff confirmed that none of the staff had a search of the central registry or a criminal record check conducted by the Virginia State Police. Plan of Correction: Fingerprints have been scheduled for all of the employees. The dates are scheduled between 09/21/2018 - 09/26/2018. Applications are all submitted for all the employees - results will be sent as soon as received.
Standard #: 63.2-1716-A Description: Based on review of center documents, additional documents submitted to the department and interviews with staff, it was determined that the child day center failed to ensure that all required documents filed with the Commissioner were complete. Evidence: 1. Four staff , caring for children during the inspection, were not listed on the staff/child ratio sheets and their staff health report was not submitted to the department in June of 2018 with their annual paperwork. a. Staff #1 has an employment date of June of 2014. b. Staff #3 has an employment date of May 2015. c. Staff #4 has an employment date of November 2010. d. Staff #5 has an employment date of September 2015. 2. Administrative staff verified that the above staff were working in the child day program since their hire dates listed in their employment files. Plan of Correction: An updated staff-child ratio information sheet will be submitted.
Standard #: 63.2-1716-A-4 Description: Based on review of 11 current staff records, it was determined that the child day center failed to ensure that each person in a supervisory position has been certified by a practicing physician to be free from any disability which would prevent him from caring for children under his supervision. Evidence: 1. The center was unable to provide documentary evidence of confirmation that staff members #1, #2, #3, #4 and #5 had been certified to be free from any disability which would prevent them from caring for children. 2. All of these staff were observed caring for children during the inspection. Plan of Correction: Staff Health Reports for the five employees are attached.
Standard #: 63.2-1720.1-B-2 Description: Based on review of 11 current staff records, it was determined that the child day center failed to ensure that employees hired after January 22, 2018 submitted to fingerprinting and the facility obtained the results prior to staff beginning employment. Evidence: 1. Staff #1 has been employed since August 27, 2018 and does not have the results of fingerprinting in her record. a. Staff #1 was observed caring for children during the inspection. 2. Administrative staff confirmed that a fingerprinting background check had not been obtained for staff #1 Plan of Correction: Fingerprint Background Check for staff 1 is scheduled for 09/26/2018.
