63.2(17) License & Registration Procedures
An unannounced complaint inspection was conducted in response to a complaint that was received by the licensing office on 1/30/19. Interviews were conducted with staff and staff files were reviewed for compliance. the allegations were relating to food, ratios, space and following center policies. The preponderance of evidence gathered did not support the allegations however, violations were found during this inspection. A plan of correction was obtained by the center. Standard #: 22VAC40-191-40-D-2 Complaint related: No Description: Based on review of staff records and interviews during the complaint inspection the center failed to ensure that all the required background checks are completed within 30 days of employment. Evidence: 1. Staff #1 does not have a central registry check on file. Staff #6 has a hire date of 5/18 and there is no central registry check on file. Staff # 7 has a hire date of 8/18 and there is no central registry check on file. Staff # 8 does not have a central registry record on file. Staff #9 does not have central registry check on file. Plan of Correction: We are going through all staff files and sending in central registry checks that need to be done. [sic]
Standard #: 63.2(17)-1716-A Complaint related: No Description: Based on review of the staff/parent handbook the center failed to provide written information regarding staff qualifications. Evidence: 1. After reviewing the staff/parent handbook provided by the center there was no information available regarding the qualifications of the staff/personnel. Plan of Correction: We are working on the staff/parent handbook to include the qualifications of staff/personnel. [sic]
Standard #: 63.2(17)-1716-A-3-b Complaint related: No Description: Based on review of staff/parent handbook the center did not have the staff to child ratios correct. Evidence: 1. The staff/parent handbook listed that the staff to child ratio for the five to 12 years of age is one staff to 20 children. The staff to child ratio for religious exempt facilities is one staff member for every 10 children ages 24 months to six years of age. Plan of Correction: We have already changed the staff to child ratio to 1 staff to every 10 children 24 months to 6 years in our handbook. [sic]
Standard #: 63.2(17)-1716-A-6 Complaint related: No Description: Based on review of the staff/parent handbook the center failed to provide a written disclosure to parents and guardians regarding public liability insurance. Evidence: 1. The staff/parent handbook does not disclose information about the centers public liability insurance. Plan of Correction: We are working on changes for our staff/parent handbook and will include public liability insurance information. [sic]
Standard #: 63.2(17)-1720.1-B-3 Complaint related: No Description: Based on review of staff records the center failed to obtain out-of-state child abuse and neglect search's of two staff. Evidence: 1. Two of the nine staff records reviewed listed on the sworn disclosure statements that they had lived outside of the state of Virginia in the past five years. 2. Staff #7 sworn disclosure statement signed 8/15/18 and staff # 9 sworn disclosure statement signed 4/15/18 listed they have live outside of Virginia, however, no out of staff child abuse and neglect search was conducted by the end of the 30th day of employment. Plan of Correction: We are checking every employee's file and sending them for out of state child abuse and neglect searches. [sic]
