22VAC40-191 Background Checks for Child Welfare Agencies

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

An unannounced code compliance inspection was initiated on 2/11/21 and concluded on 2/16/21. The person in-charge was contacted by telephone to initiate the inspection. There were 8 children present and 4 staff. The inspector emailed the provider a list of items required to complete the inspection. The Inspector reviewed 2 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 63.2(17)-1716-A-8
Description: Based on record review and interview, the center failed to ensure a person trained and certified in first aid will be present at the child day center whenever children are present.

Evidence:

1. The documentation of first aid provided expired 1/20/18.
2. The director verified no other staff member has a current first aid certification.

Plan of Correction: As soon as a class can be scheduled a staff member will complete first aid certification. In the future the director will ensure at least one person will be present at all times with first aid certification.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

1. The record for staff 2 documents the hire date as 8/18/20. The fingerprint-based criminal history check determination letter is dated 8/20/20.
2. The director stated the teacher they had hired quit and they had to replace her quickly. Staff 2 did not start with children until 9/2/20.

Plan of Correction: In the future staff will not be hired until the fingerprint-based criminal history check determination letter is obtained.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center failed to obtain a search of child abuse and neglect registry or equivalent registry maintained by any other state in which a new staff has resided in the preceding five years for any founded complaint of child abuse or neglect against him/her by the end of the 30th day of employment.

Evidence:

1. The record for staff 1 documents the start date at 8/1/20. The sworn statement documents staff 1 lived outside VA within the last five years. There is no documentation of a central registry check being completed in the other state.
2. The director stated she had never had an employee that has lived outside of VA in the last five years and did not realize other background checks needed to be completed.

Plan of Correction: Staff 1's last day of employment is 2/26/20. In the future out-of-state background checks will be completed as required for all new staff that have lived out of the state of VA within the last five years.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of criminal history record information check and sex offender registry check from any state in which the applicant has resided in the preceding five years prior to employment.

Evidence:

1. The record for staff 1 documents the start date at 8/1/20. The sworn statement documents staff 1 lived outside VA within the last five years. There is no documentation of a criminal history record information check and sex offender registry check being completed in the other state.
2. The director stated she had never had an employee that has lived outside of VA in the last five years and did not realize other background checks needed to be completed.

Plan of Correction: Staff 1's last day of employment is 2/26/20. In the future out-of-state background checks will be completed as required for all new staff that have lived out of the state of VA within the last five years.
