22VAC40-191 Background Checks for Child Welfare Agencies
On May 22nd, 2015 an allegation came into the Fairfax Licensing Office regarding Supervision and Forbidden Actions. On May 27th, 2015 an investigation with two local agencies was conducted at the provider's day care. Based upon the preponderance of evidence the allegation regarding Supervision is deemed to be Valid. Based upon the preponderance of evidence the allegation regarding Forbidden Actions is deemed to be Not Valid. Standard #: 22VAC40-111-180-A Complaint related: No Description: Based on record review, 1 of 3 staff members did not have a Report of Tuberculosis Screening every two years from the date of the first screening. Evidence: Staff #3 last had a Tuberculosis Screening Report completed on 4/15/2013 Plan of Correction: Will obtain check
Standard #: 22VAC40-111-570-A Complaint related: Yes Description: Based on multiple interviews conducted by local agencies and record review, it was determined that on the date of the allegation, 5/21/2015, the family day home exceeded the 16 points per caregiver ratio. Evidence: During interviews conducted by local agencies it was determined that the provider, on May 21st, 2015, went upstairs for lunch for 30 minutes while 2 other providers cared for the children during nap time. There were 12 children plus the provider's child in attendance on May 21st, 2015 and based on record review it was determined that the provider had 42 points in the family day home. When the provider left the day care space for the 30 minutes she was no longer in direct care and supervision of each child which requires the provider to be aware of and responsible for each child in care, including being near enough to intervene if needed. This left 2 staff members with 42 points, or 21 points each, which is more than the allowable amount of 16 points per staff. Plan of Correction: Will have lunch in the day care.
Standard #: 22VAC40-191-40-D-1-b Complaint related: No Description: Based on record review 1 of 3 staff members did not have original background searches within the required time frame of being hired. Evidence: Staff #3 was hired on March 6th, 2015 and does not have a returned Central Registry Search or Criminal Record Check within 30 days of hire. The Criminal Record Check was signed on March 6th, 2015 but had yet. to be returned. The Central Registry Check was notarized May 11, 2015 and had not yet been returned to the provider. The staff member is currently still working at the family day home. Plan of Correction: Will obtain check

Standard #: 22VAC40-191-40-D-5-a Complaint related: No Description: Based on record review, a household member does not have a central registry check on file within 30 days of a 14-year-old beginning to reside in the home or a person in the home becoming 14 years old. Evidence: Household member #2 is 15 years of age and does not have a central registry check on file. Plan of Correction: Will obtain check.
