Code of Virginia 63.2-1720.1.D, effective July 1, 2014, states employees are prohibited from working in a position that involves direct contact with a person or child receiving services until a criminal record clearance has been received, unless that person works under the direct supervision of another employee for whom a background check has been completed. Direct supervision means that the employee will remain within sight and sound supervision of an employee with a completed background check.
An unannounced monitoring inspection was conducted with provider and two assistants. There were eleven day care children and three resident children present, ranging in age from 4 months to 5 years, totalling 35 points. The children were waking from rest, having afternoon snack, playing with age appropriate toys including play dough, cars, blocks, and infant toys. There are no children receiving medication at day care - Medication Administration Training certification is valid until 10/3/2018. First aid and CPR certification is valid until 10/17/2017. Standard #: 22VAC40-191-40-D-1-c Description: Based on review of four household and staff files, the provider failed to have repeat background checks before three years since the dates of the last sworn disclosure statement, most recent central registry finding, and most recent criminal history record check report. Evidence: Household members 1 and 2 did not have documentation of a repeat sworn disclosure statement (expired 10/21/2016), a repeat central registry check (expired 10/13/2016), and a repeat criminal history record check report (10/22/2016). Plan of Correction: Provider will mail the repeat background checks to be completed as soon as possible.
