A complaint investigation was initiated on September 6, 2018 from 12:55pm to 1:40pm regarding use of inappropriate behavior guidance and forbidden action. Interviews were conducted. Documentation was reviewed. There were 5 children (14 pts) present in the care of 2 caregivers. Children were observed sleeping on their mats. There was a preponderance of evidence to support the allegation regarding inappropriate behavioral guidance; therefore the complaint was deemed valid. Description: Based on documentation reviewed, the provider did not maintain complete children?s records. Evidence: Child 1 and 2 do not have written authorization for emergency medical care should an emergency occur and the parent cannot be located immediately.

Description: Based on two records reviewed, the provider did not provide all required information in writing prior to the child's first date of attendance. Evidence: Child 1 and 2 are missing information in writing regarding: liability insurance, emergency preparedness plan, medication policy, check in and out procedures, termination policy, discipline policy, fee schedule, food policy, substitute provider information, holidays, and general daily schedule.

Plan of Correction: Do not agree with violation. Children were called their attention for a period of two weeks and they continued behavior. A "raised" voice and a demonstration of no hitting was the next step. Where is the line? We'll review behavioral guidance, if any, to provide constructive direction.

Complaint related: Yes
Description: Based on interview, a staff member did not provide behavioral guidance that is constructive in nature such as giving positively worded direction and modeling and redirecting children to acceptable appropriate behavior. Evidence: Staff 1 confirmed while intervening with children who were rough housing, Staff 1 responded to a child in a raised voice, "No hitting!" and demonstrated the action of hitting by using the their own hand to tap the hip area of Child 1, 2, and 3.
