Comments:
11/07/2018 - The Violation Notice was amended as a result of a first step review.

The licensing inspector completed an unannounced monitoring inspection on Thursday, October 11, 2018 from 12:00pm to 1:35pm to determine the provider?s compliance with licensing standards. There were a total of 9 children in care totaling 24 points with one caregiver and two assistant caregivers. Upon the inspector's arrival, the children were eating snack and watching television. The children were later observed taking bathroom breaks and preparing for nap time. The provider and assistants were observed having positive interactions with the children throughout the inspection. All areas used for child care were inspected. The family day home has age and stage appropriate materials and supplies. The licensing inspector interacted with the children when appropriate. The first aid kit and non-emergency supplies, daily attendance, and fire and shelter-in-place drills were inspected. The required postings were reviewed and found to be in compliance.

Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the Violation Notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Violations:
Standard #: 22VAC40-111-30-A
Description: Based on observation on 10/11/2018, the provider did not ensure compliance with the terms of the current license issued by the department and relevant local laws.

EVIDENCE: 1) During the inspection, the licensing inspector observed two assistant caregivers in the family day home. 2) During interview, the provider stated that Assistant #2 does not reside in the home. The terms of the license stipulate that no outside employees are permitted per the local zoning administrator.

Plan of Correction: The provider's response for the "plan of correction" was not received as of 10/23/2018 and will not appear on this Violation Notice.

Standard #: 22VAC40-111-90-A
Description: Based on a review of four children's records and interview on 10/11/2018, the provider did not obtain documentation that one child had been adequately immunized before the child attended the family day home. EVIDENCE: 1) Child #2's (DOA: 06/18/2018) immunization record was dated 06/26/2018. The immunization record on file indicated the child was not adequately immunized as of 06/26/2018.

Plan of Correction: Per Provider: I will talk with parent to make sure [they] get the paper to doctor for him to sign by 10/18/2018.

Standard #: 22VAC40-111-180-A
Description: Based on a review of documentation and interview on 10/11/2018, the provider did not maintain a current Report of Tuberculosis (TB) Screening form for an assistant caregiver every two years from the date of the first screening or more frequently as recommended by a physician or the local health department. EVIDENCE: 1) The record for Assistant #1 contained a TB screening test dated 01/06/2016. 2) The provider confirmed the TB screening for Assistant #1 expired effective 01/06/2018.

Plan of Correction: Per the Provider: Make sure I recheck paper work. Post [TB results/follow-up] on wall. 10/15/2018.
