63.2 Licensure and Registration Procedures

Comments:
An unannounced monitoring inspection was completed on December 5, 2018 from approximately 12:00p.m. to 2:00p.m. Seven children were initially in care and two more arrived during the inspection. The children's ages ranged from infant to four years old, for a total of twenty-one points. The children were observed interacting with the provider and a substitute caregiver/assistant, during arrival, toileting, hand washing, feeding, nap time and arising from nap time. Children?s toys, learning materials, equipment, inside space, bathroom and the home?s first aid kit and emergency supplies were inspected. Five children?s records, three caregiver records, two household members? records, emergency preparedness plan, fire drill, shelter in place and lock down drill logs, daily attendance, injury reports and required postings were reviewed. Transportation is not provided and medication is not administered. The provider and an assistant were available for interview, inspection and exit interview at which time inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the provider. Violations:
Standard #: 22VAC40-111-100-A
Description: Based on a review of children?s records and interview, the licensee failed to obtain documentation of a physical examination prior to the child?s attendance or within 30 days after the first day of attendance for one of five children. Evidence: 1. Child #3's record lacked an enrollment date. In an interview with Caregiver #2 it was determined that Child #3 has been in care since October 17, 2018. 2. Child #3?s record lacked a physical. 3. Caregiver #1 acknowledged the physical was not obtained prior to attendance or within 30 days after the first day of attendance.

Plan of Correction: The provider will obtain the physical from the parent.

Standard #: 22VAC40-111-120-B
Description: Based on a review of caregiver records, the licensee failed to ensure caregiver records contain all the required elements for two of three caregivers. Evidence: 1. Caregiver #2 and Caregiver #3?s record lacked a date of hire. 2. Caregiver #1 acknowledged this information was documented in the records.

Plan of Correction: The provider will add the start dates for all caregivers in the records.

Standard #: 22VAC40-111-60-B
Description: Based on a review of children?s records, the licensee failed to maintain all the elements of a child?s record for four of five children. Evidence: 1. Child #1, Child #3, Child #4 and Child #5's records lacked a start date. 2. Caregiver #1 acknowledged this information was not documented.

Plan of Correction: The provider will add the start dates to the records.

Standard #: 22VAC40-111-70-A
Description: Based on a review of children?s records and interview, the licensee failed to ensure that before the first day of attendance, parents were provided all the required information in writing for one of five children. Evidence: 1. Child #3's record contained no documentation of written notification to parents regarding operating information, fees and payments, check in and check out procedures, daily schedule, provisions for food, pet information, discipline policies, policies for termination of care or time per week that an assistant or substitute provider is scheduled to care for the child. 2. Child #3's record lacked an enrollment date but in an interview with Caregiver #2 it was determined that Child #3 was enrolled on October 17, 2018. 3. Caregiver #1 acknowledged this information was not provided to Child #3's parents before the child's first day of enrollment.

Plan of Correction: The provider will provide the missing information to the child's parent.

Standard #: 22VAC40-111-180-A
Description: Based on a review of caregiver records, the licensee failed to ensure that each caregiver obtain a tuberculosis screening every two years for one of three caregivers. Evidence: 1. The most recent tuberculosis screening in Caregiver #1's record was dated October 3, 2016. 2. Caregiver #1 acknowledged a subsequent screening has not been obtained every two years.

Plan of Correction: The provider will ensure that Caregiver #1 obtain a tuberculosis screening and the provider will start writing down the due dates as a reminder.

Standard #: 63.2-1721.1-B-2
Description: Based on review of caregiver records, the licensee failed to obtain fingerprint results for one of two household members residing in the home on January 22, 2018, by the required date of September 30, 2018. Evidence: 1. HHM #1's record contained no fingerprint results. 2. Caregiver #1 acknowledged fingerprint results were not obtained for HHM #1. Caregiver #1 advised this has been due to ongoing health issues with HHM #1.

Plan of Correction: The provider will ensure that HHM #1 obtain fingerprint results as soon as possible and will notify the department in writing within ten days that the background checks have been requested no later than ten days following this notification.
