Please note this complaint investigation was conducted jointly with other local agencies. However, the findings and rationale of these agencies are determined separate from those of the Virginia Department of Social Services Licensing Division.

Comments:
A complaint investigation regarding supervision was initiated with other local agencies on 4/1/2019 and ended on 4/17/2019. Based on staff interviews, video documentation, record keeping and observation, there was a preponderance of evidence to support the allegation. Both complaint related and non-related violations are identified in the Violation Notice. If you have any questions regarding the inspection, please feel free to contact me. Complaint related: No
Description: Based on record review and provider statement a child in care did not have a record at the Family Day Home. Evidence: Child #9 was present on 4/5/2019 and no record was on-site.

Plan of Correction: Child #9 is no longer in the care of the Family Day Home.

Standard #: 22VAC40-111-90-A
Complaint related: No
Description: Based on provider statement, the provider did not obtain documentation that the child has been adequately immunized according to the requirements of ? 32.1-46 A of the Code of Virginia and applicable State Board of Health regulations. Evidence: Child #9 was at the day care on 4/5/2019 and no record was available to verify immunization record.

Plan of Correction: The record was requested. Child #9 is no longer being cared for at the Family Day Home.

Complaint related: No
Description: Based on record review, the provider did not obtain from each adult household member prior to coming into contact with children a current Report of Tuberculosis Screening form published by the Virginia Department of Health or a form consistent with it documenting the absence of tuberculosis in a communicable form. Evidence: Household Members #1 and #2 had moved into the family day home on 2/28/2019 and were observed interacting in the day care with children during the inspection on 4/1/2019.

Plan of Correction: Household Member #1 has completed TB screening. HHM #2 has scheduled a TB screening.

Description: Based on observation, areas of the backyard fence are not maintained in a clean, safe or operable condition. Evidence: The fence enclosing the backyard was splintered or broken in multiple spots. One section was leaning into the adjourning backyard.

Plan of Correction: Fixed all broken fence pieces.

Description: Based on observation, a mobile with tied parts was was not removed from an occupied crib when the child is 5 months of age. Evidence: Child #2 (11 months) was observed sleeping in a crib on 4/1/2019 with a mobile attached to the side rail. The child's age was verified by the provider.

Description: Based on observation and staff statements, a prohibited piece of equipment was used in the backyard. Evidence: Two infant walkers were observed in the backyard with other toys and equipment for children's use. The provider and assistant #1 stated that the walkers were used when the children were in the backyard.

Plan of Correction: The walker was disposed of.

Complaint related: Yes
Description: Based on local agency report and witness statements, the caregivers did not provide direct care and supervision of a child as they were unaware of the child's whereabouts and were not close enough to intervene when needed. Evidence: 1. Child #1 (age15 months) was in care on 3/28/2019 at the Family Day Home. At approximately 10:07 am he was observed on Adult #1's video leaving the home and running down Washington Drive. The current posted speed limit on Washington Drive is 15 mph and is highly traveled by cars. 2. The child was seen by a passerby (Adult #2) who was driving down the street. Adult #2 exited the car at approximately 10:18 am and secured child #1 as the child was unattended and alone in the middle of the street. 3. Adult #2 contacted the local police who arrived and assumed custody of Child #1 into his cruiser. 4. The Officer was approached by Adult #1 and told that there was a day care on the street. The Officer approached the home and confirmed with the provider that Child #1 was in her care for the day. The provider was notified that Child #1 had been found outside the fenced backyard on Washington Drive and was not under adult supervision for approximately 11 minutes.

Plan of Correction: 1. Reinforced main wooden gate. 2. Reinforced secondary chain link gate. 3. Implemented new protocol for counting kids repeatedly. 4. Each caregiver takes responsibility for specific children and watches them while outside.

Complaint related: Yes
Description: Based on staff statements, the caregivers present did not actively supervise a child during outside play to minimize the risk of injury to a child. Evidence: 1. On 3/28/2019, three caregivers were outside in the backyard with six day care children and two grandchildren. The 3 caregivers state that the children had been taken outside to play at approximately 10:00 am. 2. The provider stated that she "went inside at 10:10 am for approximately 10 minutes to prepare snack and water for the children outside." While inside the home, the Provider became aware that the police officer was out in front of the home with Child #1 in the car and not out back with the other children and two assistant caregivers in the backyard. 3. Assistant #1 states she was watching "two young children (child #2 and #3) in a bouncy seat and the walker on the patio area" while Assistant #2 was "watching 5 children (child #4-8) by the swing set in the backyard." 4. The Provider states that she saw Child #1 "walking in the backyard" before she went into the home for snack and water. 5. Child #1 was able to exit the backyard and was found walking down Washington Drive by a passerby in a car. None of the caregivers were actively supervising Child # 1 as he was able to exit through the gates and out to the street.

Plan of Correction: 1. New protocol to count children every time a caregiver needs to leave or return from watching children. 2. Assign child to each caregiver. 3. More frequent count of children.

Complaint related: No
Description: Based on observation, the caregiver did not ensure that children's hands were washed with liquid soap and warm running water before eating. Evidence: Assistant #1 served snack to two children in the main room during the inspection and the children did not wash their hands before eating.

Plan of Correction: Children are all taken to the bathroom to wash their hands before eating every time.

Description: Based on record review, Household Members (HHM) are missing parts of the background checks. Evidence: HHM #1 and HHM #2 moved into the home on 2/28/2019 as confirmed by the provider and did not have a Sworn Disclosure Statement by the end of the first day of residing in the home or a search of the Central Registry within 30 days of residing in the home.

Assistant #3 was working on 3/29/2019 and 4/5/2019 without having submitted to fingerprinting and no eligibility letter was on file at the home.

Description: Based on record review, two adults living in the family day home did not have completed fingerprint checks prior to moving into the home. Evidence: Household Members #1 and #2 moved into the home on 2/28/2019 and have not undergone a fingerprint check as of 4/1/2019.
