Technical Assistance:
The licensing inspector and the licensee discussed the following: Children under 2 years shall not have access to the stairs, and pressure mounted gates shall not be used (22VAC40-111-430). The licensee shall ensure that a caregiver does not exceed 16 points, and points do not double during nap time, nor at any other time during the hours of operation (22VAC40-111-570).

Comments:
An unannounced monitoring inspection was conducted on June 6, 2019 from approximately 10:45 AM to 1:00 PM to determine the provider's compliance with licensing standards and to follow-up on previous areas of non-compliance. In attendance were 9 children totaling 20 points being supervised by the provider and an assistant. The children were observed interacting with the provider and the assistant, having circle time, completing a craft, washing hands, having lunch, and napping. Lunch today consisted of macaroni and cheese, corn, pineapple, wheat bread and milk. Children's books, toys, and equipment were inspected and found to be age appropriate and in operable condition. The children's restroom was inspected with the required supplies present. The family day home had the required postings displayed. The first aid kit and emergency supplies were inspected with the required items found. There is no medication being administered at this time. Five children's records and the caregiver/household member records were inspected. The following was also inspected: emergency drill logs, parent agreements, and other pertinent information. Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to the licensing office within 5 business days. Your plan of correction should contain 1) steps to correct the non-compliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Standard #: 22VAC40-111-30-A
Description: Based on record review and interview, the licensee did not ensure compliance with relevant federal, state, or local laws. Evidence: 1. The licensing inspector observed that the licensee's zoning permit does not authorize the licensee to employ a caregiver who is not a resident of the home. 2. Caregiver #1 stated the fee has been paid for the zoning permit change, and Caregiver #1 must next attend a zoning meeting on 6/27/19 for the next stage in the process of having the zoning permit modified.

Standard #: 22VAC40-111-180-A
Description: Based on the review of two caregiver records, one record did not contain a current Report of Tuberculosis Screening. Evidence: The most recent tuberculosis screening documented in the record for Caregiver #1 was dated 7/8/16. The provider shall obtain for each caregiver and adult household member a current Report of Tuberculosis Screening every two years from the date of the first screening or more frequently as recommended by a physician or the local health department.

Description: Based on a review of two caregiver records, one record did not contain documentation of completing 16 hours of training annually in areas relevant to their job responsibilities. Evidence: The licensing inspector observed the record for Caregiver #1 contained documentation of having obtained 5.5 hours of annual training from 5/25/18 to 5/25/19.

Standard #: 22VAC40-191-40-D-5-a
Description: Based on the review of one household member record, the licensee did not obtain a Central Registry check within 30 days of a 14-year-old in the home becoming 14 years old. Evidence: The licensing inspector observed the record for Household Member #1 (became 14-years-old on 3/2/19) contained a Central Registry finding dated 5/8/19.
