Comments:
The inspector conducted an unannounced non-mandated complaint inspection on 06/05/2019 based on a a complaint incident. One provider had nine children ages infant through school-age for a total of 23 points. Five children's records and provider records had been reviewed at a mandated inspection held earlier in the day. Based on the evidence gathered, the complaint is substantiated. Description: Based on observation, record review and interview, the provider failed to ensure that the caregiver did not exceed 16 points by using the point system. Evidence: 1. The inspectors conducted an unannounced mandated inspection on 06/05/2019 from 10:30am until 12:30pm. During the mandated inspection, the inspector counted and the provider acknowledged there were nine children in care for a total of 23 points with the provider and assistant present. There were three infants, five children between 2- 4 yrs. of age and one child between the age of 5-9 yrs. old. After completing the inspection and leaving the home, while at a gas station at 12:50pm, the inspectors observed the assistant provider driving their car by the gas station. The inspectors went back to the home at 1:00 and did not see the car in the driveway. 2. The inspectors went in the home and the provider stated the assistant had left to go get medicine. 3. The inspector asked if anyone else took the assistant's place and the provider stated no and acknowledged no children had left care since the inspectors had left the house. 4. The assistant was not at the home between 1:00-1:10pm during inspection. The inspectors remained in the area where the family day home is located until 1:24 pm and the assistant had not returned to the home. The total verified time the provider was home alone with nine children and 23 points was 34 minutes.

Plan of Correction: The provider said she would be getting some help with her family day home for when her assistant needed to be out of the house.
