Comments:
The licensing inspector conducted an unannounced non-mandated inspection from 11:00 am until 11:50pm. The acting licensing administrator was also present. There were eight children care ages infant-11 yrs. old with one caregiver present for a total of 16 points. There were four repeat violations. Children were observed in a crib, in an infant seat, and playing outside and watching T.V. The licensing administrator reviewed the terms of the special notice (civil penalty and notifying parents) dated April 24, 2019. Violations were reviewed with the provider and and acknowledgment form was signed by and left with the provider. Please call your inspector at 276-698-9981 with any questions.

Violations:
Standard #: 22VAC40-111-30-A
Description: Based on interview, the provider did not ensure compliance with the standards and the terms of the current license issued by the department and with relevant federal, state or local laws, and other relevant regulations. Evidence: 1. The provider verified she had an 11 yr. old in care the day of the inspection. The provider is licensed for ages 12 weeks-8 years 11 months.

Plan of Correction: The provider has requested a modification of the license to include children up to the age of 12 yrs. 11 months.

Standard #: 22VAC40-111-50-A
Description: Based on interview, the family day home failed to keep a written record of children in attendance each day. Evidence: 1. The inspector asked to see the written record of children in attendance and it was not made available.

Plan of Correction: Provider will keep an attendance sheet of the children in care each day.

Standard #: 22VAC40-111-60-A
Description: Based on interview, the provider failed to maintain an up-to-date record at the family day home for each enrolled child. Evidence: 1. The inspector asked to see the record for child #1 and the provider was not able to find it.

Plan of Correction: The provider will find the file and make sure it is up to date.

Standard #: 22VAC40-111-90-A
Description: Based on interview, the family day home failed to obtain documentation that a child had been adequately immunized before the child attended the family day home. Evidence: 1. The inspector asked to see the record for child #1 and the provide could not find it.

Plan of Correction: The provider will find the immunization record for the file.

Standard #: 22VAC40-111-460-C
Description: Based on interview, the dogs were not vaccinated. Evidence: 1. The inspector asked to see the rabies vaccination for dog #1 and the provider stated they were not able to make the appointment last month to get the dog the vaccination. This is a repeat violation.

Plan of Correction: Provider will get the dog vaccinated 7/27/2019.

Standard #: 22VAC40-111-530-B
Description: Based on observation, the cribs when being used by an infant did not have a tight-fitting bottom cover. Evidence: 1. The inspector observed child #2 asleep in the crib and there was no sheet on the mattress. This is a repeat violation.

Plan of Correction: Provider will make sure the cribs have tight-fitting sheets.

Standard #: 22VAC40-111-560-C
Description: Based on observation and interview, the caregiver allowed children under the age of school-age to play outdoors while the caregiver was indoors. Evidence: 1. Upon arriving at the home, the inspector observed four children playing outside in the backyard unsupervised; the caregiver was inside with the other 4 children in care. 2. The provider stated that two children were three years old (child #3 and #4) ) , one children was 2 years old, (#5) and one child was school-age (#1). 3. There was no record for child #1 but she stated she was five years old and her birthday is in September and she will be 6 yrs. old. 4. The inspector reviewed records at a prior inspection and verified ages: child #3 and #4 are three years old, and child #5 is two years old.

Plan of Correction: The provider will not allow preschool age children to play outside unless they are being supervised.

Description: Based on observation and interview, the provider did not have the most recent inspection posted. Evidence: 1. The inspector asked where the last inspection was posted and the provider verified it was not posted.

Plan of Correction: The provider will post the most recent inspection.

Standard #: 22VAC40-80-120-E-6
Description: Based on observation, the provider did not have posted the the special order dated April 26, 2019. Evidence: 1. The provider verified the special order was not posted. This is a repeat violation.

Plan of Correction: The provider stated it had been posted.
