Comments:
An unannounced focused visit was conducted today between the hours of 10:35 am through 12:30pm with the provider on site. There were 10 children (28 points) with the provider. The provider was over maximum capacity. A sample of 6 children's files and 2 staff/household member's files were reviewed. The children were engaged in the following: toy play, listening to music and bathroom breaks and preparing for lunch. Interactions between the children and caregivers were positive. The physical space, evacuation drills and attendance records. Areas of non-compliance are identified in the violation notice. Standard #: 22VAC40-111-780-B
Description: Based on interview and record review, the provider failed to complete a yearly review with the parent the emergency contact information and obtain the parent's signed acknowledgement of the review. Evidence: 1. Child #3 did not have documentation of the review with the parent the emergency contact information required in 22 VAC 40-111-60 B 2 to ensure the information is correct, and obtain the parent's signed acknowledgment of the review. It was last signed on 3/11/2018. 2. Child #6 did not have documentation of the review with the parent the emergency contact information required in 22 VAC 40-111-60 B 2 to ensure the information is correct, and obtain the parent's signed acknowledgment of the review. It was last signed on 7/18/2018.

Plan of Correction: I will make sure the parents review and sign.

Standard #: 22VAC40-111-830-A
Description: Based on record review, the emergency evacuation procedures were not practiced monthly with all caregivers and children in care during all shifts that children are in care. Evidence: 1. The provider did not practice the emergency evacuation procedures with the children the month of June 2019 or July 2019.

Plan of Correction: I will make sure the drills get done each month.

Standard #: 22VAC40-111-40-A
Description: Based on observation, the provider failed to ensure that the total number of children receiving care at any one time does not exceed the maximum licensed capacity of the home. Evidence: 1. During the inspection today, there were 10 children in care. The provider's maximum licensed capacity is 7 children. 2. The attendance sheet documentation confirmed that the provider had 8 children on 8/13/2019 and was over capacity.

Plan of Correction: I will stay within the allowed capacity.

Standard #: 22VAC40-111-500-D
Description: Based on observation, outdoor play equipment outside of the family day home did not meet all requirments. Evidence: 1. The swing set had 4 S" hooks that were not tightly closed.

Plan of Correction: I will change the hooks or remove it.

Standard #: 22VAC40-111-540-A
Description: Based on observation, infant seats were not being used according to the manufacturer's instructions and when occupied by a child, a safety strap was not used and securely fastened. Evidence: 1. Two infants (5 month old and 7 month old) were observed infant seats without a safety strap being used or securely fastened.

Plan of Correction: I will make sure they are used every time correctly.
