63.2 Licensure and Registration Procedures

Technical Assistance:
Written information was left regarding safe sleep. Mesh sided cribs are prohibited for use as a sleep space in licensed family day homes.

Comments:
An unannounced monitoring inspection was conducted on 08/29/2019 from 12:10 pm - 2:05 pm. At the time of entrance there were eight children in care with two caregivers. The ages of the children counted for a total of 18 points. Children were observed napping in the child care room. Records were reviewed for nine children, two caregivers and three household members. The entire home was reviewed during this renewal inspection.

Areas of noncompliance were observed in five parts of the FDH standards and are listed on the violation notice.

Violations:
Standard #: 22VAC40-111-730-D
Description: Based on observation, the provider failed to ensure that medication, except for those prescriptions designated otherwise by a written physician's order, including refrigerated medication and medications for caregivers and household members, shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1. One bottle of over-the-counter medication was observed stored on top of the refrigerator in the kitchen.
a. The provider stated this medication belonged to her family.

Plan of Correction: This medication will be placed in a locked location today.

Standard #: 22VAC40-111-890
Description: Based on observation, the provider failed to ensure that when food is brought from home the food container shall be clearly labeled in a way that identifies the owner.

Evidence:
1. Five bags of frozen breast milk were not dated and labeled to identify the owner.
2. The provider stated that this breast milk belonged to child 3.

Plan of Correction: Going forward all breast milk will be dated and labled.

Standard #: 22VAC40-111-960-E
Description: Based on observation, the provider failed to ensure that bottles shall be dated if more than one infant is in care.

Evidence:
1. Two bottles, for two different infants in care, were not dated.

Plan of Correction: All bottles will be dated if more than one infant is in care.

Standard #: 22VAC40-111-60-B
Description: Based on record review, the provider failed to ensure that children's records contain all of the required elements.

Evidence:
1. The enrollment record for child 1 lacked the following:
a. Proof of the child's age and identity;
b. The address for the two designated emergency contacts;
c. The place of employment, employment address and phone number for each parent.
2. The enrollment record for child 2 lacked the work phone number and address for one parent.

Plan of Correction: The birth certificate was reviewed for child 1. This verification will be documented.
The parent of child 1 will be asked to provide an address for both emergency contacts.
The parent of child 1 and child 2 will be asked to clarify employment information.

Standard #: 22VAC40-111-520-C
Description: Based on observation and interview, the provider failed to ensure that cribs shall not have mesh sides.

Evidence:
1. A mesh sided portable crib was observed in the family room of the home. The provider stated that she used this mesh crib as a sleep space for one infant in care.

Plan of Correction: This mesh crib will no longer be used as a sleep space immediately. A regular crib will be used for napping of each infant in care.

Standard #: 22VAC40-111-530-A
Description: Based on observation, the provider failed to ensure that cots when being used for sleeping or napping by children other than infants shall have linens consisting of a top cover and a bottom cover or a one-piece covering that is open on three edges.

Evidence:
. Four children were observed napping on cots without a top cover and bottom cover.

Plan of Correction: Each child does have a sheet and blanket however, it was not offered due to the warm weather. Going forward, each child will be provided with a sheet and blanket.

Standard #: 22VAC40-111-690-E
Description: Based on observation, the provider failed to ensure that soiled disposable diapers and wipes shall be disposed of in a leak-proof or plastic-lined storage system that is either foot operated or used in such a way that neither the caregiver's hand nor the soiled diaper or wipe touches the exterior surface of the storage system during disposal.

Evidence:
1. A plastic grocery bag was observed hanging from the handle of the children's bathroom door in the child care room. This bag was filled with multiple soiled diapers and used wipes.
a. This bag was accessible to the children in the child care room.

Plan of Correction: The bag of diapers was disposed of during the inspection. Diapers will now be disposed of in the step down diaper pail at all times.
