Technical Assistance:
The licensing inspector and the provider reviewed the requirements for attendance records as listed in 22VAC40111-50A.

Comments:
The inspector conducted an unannounced focused inspection on September 18, 2019 from 1:30 PM to 3:00 PM. This visit focused on the main area(s) of previous non-compliance. The licensee's policies and procedures were reviewed, records were reviewed, and observations were made. There was one repeat violation cited, and other areas of non-compliance were cited.

Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and return it to the licensing office within 5 business days. Your plan of correction should contain 1) steps to correct the non-compliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Violations:
Standard #: 22VAC40-111-120-B
Description: Based on a review of two caregiver records, one record did not contain the required documentation. Evidence: The record for Caregiver #2 (verbal date of hire reported as 8/21/19) did not contain documentation of the caregiver's date of hire, job title or orientation training.

Plan of Correction: The provider's responses for the "plan of correction" were not received as of 9/30/19 and will not appear on the Violation Notice.

Standard #: 22VAC40-111-30-A
Description: Based on a record review and interview, the provider did not ensure compliance with relevant federal, state, or local laws. Evidence: 1. The licensing inspector observed that the licensee's zoning permit does not authorize the licensee to employ a caregiver who is not a resident of the home. 2. During an interview with the licensing inspector, Caregiver #1 reported that Caregiver #2 is not a resident of the home. Caregiver #1 reported having prior knowledge of the necessity of a zoning permit to employ a non-resident.

Standard #: 22VAC40-111-60-A
Description: Based on an interview and a review of five children's records, the provider did not maintain an up-to-date record for each enrolled child. Evidence: During an interview, Caregiver #1 reported having no record for Child #5 who is three years old. The licensing inspector observed no record for Child #5.

Standard #: 22VAC40-111-60-B
Description: Based on a review of five children's records, three records did not contain the required documentation. Evidence:
1. The record for Child #2 (start date 2/19/19) did not contain a medical insurance policy number.
2. The record for Child #3 (start date 9/17/19) did not contain the name and phone number of the health care provider and did not contain a medical insurance policy name or number.
3. The record for Child #4 (start date 9/9/19) did not contain the medical insurance policy name or number.

Standard #: 22VAC40-111-70-A
Description: Based on a review of five children's records and interviews, the provider did not provide the required written information to parents prior to attendance for four children Evidence: The records for Child #1 (start date 8/26/19), Child #2 (start date 2/19/19), Child #3 (start date 9/17/19), Child #4 (start date 9/9/19) did not contain the following documentation: Information for Parents, Policy for the Administration of Medication, Liability Insurance Declaration, or the Provisions of the Home's Emergency Preparedness and Response Plan. Caregiver #1 reported that the information was not provided to parents.

Standard #: 22VAC40-111-150-D-1
Description: Based on a review of two caregiver records and caregiver interviews, the provider did not ensure that an assistant 18 years of age or older who is left alone with children in care shall have a current certification in cardiopulmonary resuscitation (CPR). Evidence: The licensing inspector observed the record for Caregiver #2 (reported date of hire 8/21/19) did not contain documentation of a current certification in CPR. During an interview, each caregiver reported that Caregiver #2 had been left alone with children in care on multiple occurrences.

Standard #: 22VAC40-111-150-D-2
Description: Based on a review of two caregiver records and caregiver interviews, the provider did not ensure that an assistant 18 years of age or older who is left alone with children in care shall have a current certification in first aid. Evidence: The licensing inspector observed the record for Caregiver #2 (reported date of hire 8/21/19) did not contain documentation of a current certification in first aid. During an interview, each caregiver reported that Caregiver #2 had been left alone with children in care on multiple occurrences.

Standard #: 22VAC40-111-330-A
Description: Based on observation and interview, the provider did not ensure that there was a landline telephone available, operable, and accessible that does not require electricity to operate. Evidence: The licensing inspector observed no landline telephone in the family day home. The provider stated the home did not have a landline phone that does not require electricity to operate.

Standard #: 22VAC40-111-340-C
Description: Based on observation, the provider did not ensure that the bathroom shall contain the required supplies. Evidence: The licensing inspector observed that the bathroom located upstairs did not contain paper towels. The licensing inspector observed that a child in care was sent to use the bathroom located upstairs during the inspection.

Standard #: 22VAC40-111-590-B
Description: Based on observation and interviews, the provider did not ensure that an infant was promptly moved to his designated sleeping space after falling asleep in a space other than his own crib. Evidence: 1. The licensing inspector observed Child #4 (three months old) asleep in a car seat upon arrival, at approximately 1:30 PM. 2. During an interview, Caregiver #2 reported that Child #4 had fallen asleep in the car seat at approximately 12:40 PM. Caregiver #1 and Caregiver #2 reported that Child #4 sleeps in the car seat on a regular basis due to not sleeping as soundly in a crib.
