An unannounced inspection was completed on November 6, 2019 from approximately 10:45 a.m. to 12:15 p.m. in response to a complaint received on October 11, 2019 regarding the care of children. The investigation was initiated on October 11, 2019, collateral interviews were conducted off site on October 11, 2019, November 5, 2019, November 6, 2019, and November 7, 2019. The investigation was completed on November 22, 2019. Caregivers, children and the indoor space were observed, caregivers and collaterals were interviewed and children's and caregiver's records were reviewed as related to the complaint. The provider was available for the inspection and was present for the exit interview at which time the inspection findings were reviewed and an Acknowledgement of Inspection form was signed and left with the licensee. The complaint is determined to be valid for the need for an additional caregiver. See the violation notice on the department's public website.
Standard #: 22VAC40-111-570-A Complaint related: No Description: Based on observation, an interview, and review of records, the licensee failed to ensure that a caregiver does not exceed 16 points when determining if an additional caregiver is needed.
1. On November 6, 2019, eight children were observed in care, with one caregiver for approximately thirty minutes before an additional caregiver arrived. Caregiver #1 reported the children in care included two seven month olds, one seventeen month old, one eighteen month old, one twenty-one month old, and three two-year old children, for a total of twenty-three points.
2. In an interview, Caregiver #1 reported that she has two assistants. Caregiver #1 stated that she used to have three assistants but that Caregiver #2?s last day of employment was the first week of September 2019. Caregiver #1 advised that Caregiver #3 only works on Thursdays and that Caregiver #4 works daily from approximately 9:00 a.m. to 1:00 p.m. Caregiver #1 further reported that she averages about eight to nine children in care daily who are all two years old or younger.
3. A review of attendance records for September 2019 and October 2019, and children?s records confirmed that eight to nine children were in care daily who are all two years old or younger.
4. Caregiver #1 acknowledged that since Caregiver #2 quit in September 2019 she has been the sole caregiver for all the children daily when Caregiver #4 leaves at approximately 1:00 p.m. until she closes, except on Thursdays when Caregiver #3 is present. Caregiver #1 indicates that between the hours of 6:00 a.m. to 9:00 a.m. there are only a few children present. However, Caregiver #1 reports that she is aware that after 1:00 p.m. an additional caregiver has been needed daily since the first week of September 2019.
Plan of Correction: During the inspection on November 6, 2019 a volunteer was present. The volunteer is in the process of completing all the required background checks for employment. The provider plans to hire the volunteer full time. The provider is also in the process of qualifying her daughter as a substitute caregiver in case she needs an additional caregiver.
