63.2 Licensure and Registration Procedures

Technical Assistance:
Provided a copy of "procedures for conducting background investigation" and discussed the requirement for fingerprint background checks and central registry background checks. Discussed the exception for central registry background check results by the 30th day of employment: If a central registry background check is requested within the first 7 days of employment and the provider contacts the central registry background check agency for the status of the background check on the 30th day if the results have not bee received and documents this contact including date/time of contact, person contacted and the results of the contact, then this will maintain compliance if the results are not received within 30 days of employment.

Sleeping infants should be checked in person every 15 minutes or by ways of a baby monitor that has video/sound if the infants are not within sight and sound (behind a closed door, etc).

Comments:
An unannounced monitoring inspection was conducted beginning at 10:15 a.m. and ending at 12:15 p.m. with the provider and two assistants. There were 10 children in care ranging in age from 4 months to 4 years old for a total of 28 points. Children were observed having play time with a variety of toys and equipment. Three infants/toddlers were observed sleeping in the nap room. One infant woke during the inspection. A second infant had play time in a variety of play spaces and infant equipment. After play time, children completed an activity about a 'snow bear'. After gluing their snow bears, children prepared for outdoor time. After outdoor time, children washed hands and completed their snow bear project and resumed play at various centers. After centers, children prepared for lunch. Lunch today was cheese pizza, green beans, oranges and milk

Four caregiver records and four children's records were reviewed. The weekly menu is posted.

Violations:
Standard #: 22VAC40-111-500-F
Description: Based on observation, it was determined that there was a trampoline used during hours that children are in care. Evidence: In the indoor childcare area there was an indoor trampoline that was used for children in care.

Plan of Correction: The trampoline was removed during the inspection.

Standard #: 22VAC40-191-60-C-2
Description: Based on review of documentation, it was determined that the provider did not obtain documentation of central registry background check results within 30 days of employment. Evidence: Staff #2, hired 8/19/19, did not have documentation of central registy background check results in the record.

Plan of Correction: The background check has been mailed off twice and will be followed up on today. In the future, follow up will be documneted in the staff record.

Standard #: 63.2-1720.1-B-2
Description: Based on review of documentation and interview, it was determined that fingerprint background check results were not received prior to the first day of service or employment. Evidence: Staff #1, start date 12/4/019, did not have documentation of fingerprint background checks in the record. Staff #2, hired 8/19/19, fingerprint background check was dated 11/6/2019.

Plan of Correction: Staff #1 was participating in a working interview. Staff #1 is going today to get the fingerprint check. In the future, fingerprint background checks will be conducted prior to the first day of day of service or employment.
