Technical Assistance:
Due to the background check related violations cited in today?s inspection, the provider is required to follow-up with the appropriate department regarding the status of any missing and/or incomplete background checks. Documentation of the completed follow-up must be sent to the Licensing Inspector within 10 business days, and a copy of all missing/incomplete background check results must be sent to the Licensing Inspector upon arrival.

Comments:
An unannounced renewal inspection was conducted today from 10:15am-1:30pm. There were 5 children (10 points) supervised by 2 direct care staff. The home, 2 staff records, 3 children?s records, 6 household member?s records, evacuation drills, emergency supplies, and policies were inspected. There were no medications on site today. Children were observed coloring, playing with puzzles, eating lunch, and transitioning to naptime. Lunch served was spaghetti, chicken, salad and milk. There was a sufficient amount of books, toys, and materials, which were found to be developmentally appropriate for the children in care at the time of inspection. Areas of non-compliance are identified in the Violation Notice.

Standard #: 22VAC40-111-750-B
Description: Based on observation, the provider did not ensure that topical products were inaccessible to children.

Evidence: Three tubes of children's diaper creams were found in an unlocked, top drawer of the diaper changing table.

Standard #: 22VAC40-111-920
Description: Based on observation, the menu for the current one-week period did not have the following:

Evidence:
1. The menu for the current one-week period was not dated.
2. The menu for the current one-week period did not list any substituted food. On the date of the inspection, the posted menu documented that lunch was chicken, beans, rice, carrots, cantaloupe, and milk. The actual lunch served was spaghetti, chicken, salad, pears, and milk.

Standard #: 22VAC40-111-120-B
Description: Based on record review, assistants' and substitute providers' records did not contain the following:

Evidence: Caregiver B's (date of hire: 2/24/2020) record did not contain documentation of a name, address, and telephone number for an emergency contact person.

Plan of Correction: I will have the helper fill out the form today.

Standard #: 22VAC40-111-60-B
Description: Based on record review, a child's record did not contain the following information:

Evidence:
1. Child #1's (age: 4 years old) record did not contain documentation of a completed physical form signed by the physician.
2. Child #2's (age: 4 years old) record did not contain documentation a second emergency contact person.
3. Child #3's (age 3 years old) record did not contain documentation of proof of identity, parent's signed acknowledgement of the receipt of the information required by 22 VAC 40-111-70, and documentation of the annual review of the child's emergency contact information as required by 22 VAC 40-111-780 B. The most recent documented review was dated 2/6/2019.

Plan of Correction: I will get the updated information from the parents.

Standard #: 22VAC40-111-170-A
Description: Based on record review, the provider did not obtain from each caregiver at the time of hire and each adult household member prior to coming into contact with children a current Report of Tuberculosis Screening form.

Evidence: Household member F's record did not contain documentation of a current report of TB screening form.

Plan of Correction: I will have them get it.

Standard #: 22VAC40-111-180-A
Description: Based on record review, the provider did not obtain for each caregiver and adult household member a current Report of Tuberculosis Screening form, in accordance with the requirements in 22 VAC 40-111-170, every two years from the date of the first screening.

Evidence: Household member E's most recent documented TB screening was dated 3/24/2017 (expired: 3/24/2019).

Plan of Correction: I will have them get it.

Standard #: 22VAC40-111-200-A
Description: Based on record review, the provider did not orient the substitute provider and assistant by the end of their first week of assuming job responsibilities.

Evidence: Caregiver B's (date of hire: 2/24/2020) record did not contain documentation of completed orientation.

Plan of Correction: I will have them complete the form tomorrow.

Standard #: 22VAC40-111-210-A
Description: Based on record review, the provider did not ensure that caregivers obtain a minimum of sixteen clock hours of training annually.

Evidence: Caregiver A's record contained documentation of 12 training hours for 2019.

Plan of Correction: I have classes scheduled for next Saturday.

Standard #: 22VAC40-111-280
Description: Based on observation, the provider did not ensure that potentially poisonous substances were stored away from food in areas inaccessible to children.

Evidence: A container of Clorox wipes and a bottle of hand sanitizer were found on top of the children's cubby shelf, next to where children were sitting.

Plan of Correction: Corrected during inspection.

Standard #: 22VAC40-111-460-D
Description: Based on record review, the provider did not maintain documentation of the current rabies vaccination.

Evidence: The most recent documented rabies vaccination for the dog residing at the family day home expired 4/1/2018.

Plan of Correction: I will get a copy of the current rabies vaccine and add to the dog's file.

Standard #: 22VAC40-191-40-D-4-a
Description: Based on record review, the provider did not ensure that a person living in the home of a licensed family day home conducted a central registry search within 30 days of a person beginning to reside in the home.

Evidence:
1. Caregiver B and Household member A began residing in the family day home on 1/26/2020 and did not have documentation of requested and completed central registry searches.
2. Household member D's record did not contain documentation of a completed central registry search.

Plan of Correction: I will re-submit one of the background check, and send requests for the other ones.
