This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on February 20, 2020 and concluded on June 24, 2020. A complaint was received by the department regarding allegations in the areas of supervision, confidentiality, and parent communication. The provider was contacted by telephone to conduct the investigation.
The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.
Standard #: 22VAC40-111-840-B Complaint related: Yes Description: Based on a review of documentation and an interview, the provider did not document the entire information required for an injury report. Evidence: 1. The licensing inspector observed the injury report for Child #1, dated 2/19/19, did not include either a parent's signature or a second caregiver's signature. 2. During an interview, the parent of Child #1 reported not receiving a written injury report from the provider. Plan of Correction: The provider states that she will ensure each injury report includes at least two staff signatures, or one staff signature with a parent signature.
Standard #: 22VAC40-111-50-C Complaint related: Yes Description: Based on interviews and documentation review, the provider did not ensure that information contained in a child's record shall be privileged and confidential. The provider shall not distribute or release information in a child's record to any unauthorized person without the written consent of the child's parent. Evidence: 1. During an interview on 6/24/2020, the provider stated she discussed an incident regarding an injury of Child #1 with two individuals. 2. The licensing inspector observed documentation of a discussion between the provider and another individual related to the injury of Child #1. 3. During an interview with the parent of Child #1, the parent stated that there was no written authorization for the provider to release information to any individuals relating to the child. Plan of Correction: Provider states that she will ensure that children's records and information are kept confidential unless there is a signed parental authorization to speak with a person not the parent of a child.
Standard #: 22VAC40-111-50-E Complaint related: No Description: Based on an interview, the provider did not ensure that children's records shall be maintained and made accessible to the department's representative for two years from the date of termination of services. Evidence: During an interview, the provider reported being unable to locate the record for Child #1. Plan of Correction: The provider states that she will ensure that children's records are maintained and made available to licensing for review for a period of two years following the date of termination of services.
