63.2 Licensure and Registration Procedures

Technical Assistance:
Reviewed requirements regarding hiring new employees to include timelines for obtaining backgrounds and documents. Reviewed all background requirements for caregivers and household members including new background requirements (effective 7/1/2020) for individuals who are currently residing or have previously resided outside of the state of Virginia in the past 5 years.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 12/10/2020 and concluded on 12/11/2020. The provider was contacted by telephone to initiate the inspection. There were 9 children present (29 points) and 2 caregivers. The inspector emailed the provider a list of items required to complete the inspection. The Inspector reviewed 2 children?s records and 1 caregiver record submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-60-B
Description: Based on record review, the provider did not obtain a sworn statement or affirmation for one caregiver prior to the first day of employment.

Evidence:
1. Caregiver #1 began employment on 09/28/2020.
2. The Sworn Statement in the record for Caregiver #1 was dated 10/10/2020

Plan of Correction: A sworn statement was completed on 10/10/2020.

Standard #: 22VAC40-191-60-C-2
Description: Based on record review, the provider did not obtain a central registry finding within 30 days of employment for one caregiver.

Evidence:
1. Caregiver #1 began employment on 09/28/2020.
2. Documentation of a central registry finding was not available for review in the record for Caregiver #1.

Plan of Correction: The VA Central Registry check form has been completed and notarized, and was mailed out on 12/10/2020. Provider will provide documentation of central registry check results once obtained.

Standard #: 63.2-1720.1-B-2
Description: Based on record review, the provider did not ensure staff submit to fingerprinting prior to employment.

Evidence:
Caregiver #1 began employment on 09/28/2020. Documentation of a fingerprint-based criminal history record check was not available for review in the record for Caregiver #1.

Plan of Correction: Caregiver attended appointment with FieldPrint on 12/9/2020. Provider will provide documentation of fingerprint results once obtained.
