Technical Assistance:
Discussed the importance of maintaining accurate children?s attendance and employee sign-in and out documents. Also discussed the Code of Virginia, ? 63.2-1712, regarding reports and statements to the Commissioner?s representative.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 2/16/2021 and concluded on 2/19/2021. A complaint was received by the department regarding allegations in the areas of physical equipment and environment, household members, care of children and nutrition. The provider was contacted by telephone and video call to conduct the investigation. The inspector emailed the provider a list of documentation required to complete the investigation. Interviews were conducted by telephone and video call.

The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Description: Based on interview, the provider did not keep a written record of children in attendance each day.
Evidence:
1. On 2/16/2021, the provider was asked to provide attendance records for the month of October 2020 through November 6, 2020. The provider said she would send them later that day. On 2/19/2021, the provider had not sent the requested attendance records and stated she is trying to locate them.

Plan of Correction: I will document all the arrival and departure times and keep records of attendance for 6 months

Description: Based on observation, documentation review and interviews, the provider failed to ensure that a caregiver does not exceed 16 points by using the point system to determine if an additional caregiver is needed.
Summary Statement: On 2/10/2021 at approximately 8:29am, there were 7 children in care (16 points) and 3 resident children at home (3 points) totaling 19 points with one caregiver. At approximately 8:49am, there were 8 children in care (20 points) and 3 resident children at home (3 points) totally 23 points with one caregiver. According to the point system, 2 caregivers were required beginning at approximately 8:29am until approximately 9:00am, when the second Caregiver arrived at the home.
Evidence:
1. During a surveillance of the home on 2/10/2021, 8 children were observed being dropped off at the family day home between approximately 7:24am to 8:50am.
Child 1 and Child 2 were dropped off between approximately 7:24am and 7:30am.
Child 3 was dropped off between approximately 7:51am and 7:54am.
Child 4 was dropped off between approximately 7:56am and 8:00am.
Child 5 was dropped off between approximately 8:07am and 8:11am.
Child 6 was dropped off between approximately 8:13am and 8:18am.
Child 7 was dropped off between approximately 8:26am and 8:29am.
Child 8 was dropped off between approximately 8:47am and 8:50am.
2. During a surveillance of the home on 2/10/2021, the assistant (Caregiver B) was observed arriving at the home at approximately 9:00am.
3. The provider stated that all 3 resident children (4 years old, 5 years old, and 11 years old) were present on 2/10/2021. The point total for the resident children is 3 points.
4. During an interview on 2/19/2021, the provider stated that she reviewed her doorbell security system for 2/10/2021 and observed the following arrival times of the children in care:
Child 1 - 7:28am (4 years old ? 2 points)
Child 2 - 7:28am (23 months- 3 points)
Child 3 ?- 7:52am (5 years old- 1 point)
Child 4 - 8:11am (2 years old ? 2 points)
Child 5 - 8:14am (16 months ? 3 points)
Child 6 - 8:20am (3 years old ? 2 points)
Child 7 - 8:29am (21 months ? 3 points)
Child 8 - 8:49am (14 months ? 4 points)
5. During an interview on 2/16/2021, Caregiver B stated the family day home was over points on 2/10/2021 when she arrived. She stated she was late arriving at the home because she had a flat tire.

Plan of Correction: I will all update the emergency plan to make sure I'm within compliance.
