Technical assistance was provided regarding the procedures in operating a licensed family day home. Care cannot be provided until a license has been issued. In the Commonwealth of Virginia there is a law called Joseph's law. Joseph's law states that:
According to ? 18.2-371.1 of the Code of Virginia, it is a Class 4 felony, when a person responsible for the care of a child, by willful act or willful omission or refusal to provide care for the child?s health, causes or permits serious injury to the life or health of the child. A willful act or willful omission includes operating or engaging in the conduct of a child welfare agency without first obtaining a license or after the license has been revoked or has expired and not been renewed.

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
An initial inspection was conducted on March 22, 2021. The provider was contacted by video call to initiate the inspection. The home, materials, supplies, emergency procedures and daily policies were reviewed. The Inspector reviewed 2 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Standard #: 22VAC40-111-30-A Description: Based on applicant's statement, the provider is not in compliance with State regulations.
Evidence:
Applicant stated care is currently being provided for nine children. A license to operate has not been issued by the department, therefore the provider is not in compliance with the State regulations.Plan of Correction: I have informed daycare parents and will resume care at my facility as soon as my license is approved.
Standard #: 22VAC40-111-170-A Description: Based on review of applicant's record, the record does not contain all the required documentation.
Evidence:
The applicant's record does not contain a current report of tuberculosis screening form published by the Virginia Department of Health or a form consistent with it documenting the absence of tuberculosis in a communicable form.Plan of Correction: I have since received my negative TB results and placed them in my record.
