22.1 Background Checks Code; carbon monoxide detectors

Technical Assistance:
The Code of Virginia states: Each building that was built before 2015 and that houses a child day program that is licensed pursuant to this chapter or any program described in subdivision A 4, B 1, or B 5 of ? 22.1-289.030 that serves preschool-age children shall be equipped with at least one carbon monoxide detector.

The licensee has a device on the ceiling and they stated they believe it is both a smoke detector and a carbon monoxide detector in one, but does not know for sure. The provider stated that they do not have the devices original manufacturer documents. The licensee was informed they need to be able to confirm that they have a carbon monoxide detector properly installed to ensure compliance.

Comments:
An unannounced monitoring inspection was conducted today between 11:15am and 11:45am. There were 12 children present with the Provider and 2 assistants. The children were observed playing independently, doing yoga and preparing to eat lunch. Positive interactions were observed during this inspection. A complete inspection of the physical plant, children and staff records, fire drill log, menu and attendance were observed during this inspection. Thank you for your cooperation. Violations:
Standard #: 22.1-289.035-B-2
Description: Based on interview, the provider has not obtained fingerprint results for each employee before coming in contact with children.
Evidence: Staff #2's record does not contain criminal history fingerprint results. The provider stated that the employee did the background check in November but the results were not received. Staff #2 was observed working with the children during today's inspection.

Plan of Correction: I called the fingerprint place and they told me to call the Virginia Office of Background Investigations. I will call them this afternoon to ask about the results. If they say that they don't have them, I'll make another appointment and they can do the fingerprints again.

Standard #: 8VAC20-800-880
Description: Based on record review, the family day home does not follow the most recent, age-appropriate nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United States Department of Agriculture (USDA).
Evidence: The sample food menu that the provider is using does not schedule for a full serving of fruit and a full serving of a vegetable for lunch each day.

Plan of Correction: The food menus were given to me by my food inspector. I'll call them this afternoon to ask for new menus.

Standard #: 8VAC20-800-60-B
Description: Based on record review, children's records did not contain all required information.
Evidence: Child #2 record does not contain an address for their second emergency contact.

Plan of Correction: I will tell the parents this afternoon what is missing, and I will have them bring it tomorrow.

Standard #: 8VAC20-800-80-A
Description: Based on record review, the provider has not verified the identity and age of each enrolled child within the first seven days of attendance.
Evidence:
1. Child #2 (date of enrollment: 9/27/2021) record does not contain documentation that the provider had verified the child's identity and age.
2. Child #4 (date of enrollment: 6/1/2021) record does not contain documentation that the provider had verified the child's identity and age.

Plan of Correction: I will tell the parents this afternoon what is missing, and I will have them bring it tomorrow.

Standard #: 8VAC20-800-170-A
Description: Based on interview, the provider did not obtain a tuberculosis (TB) screening for each employee before coming in contact with children.
Evidence: The provider stated that Staff #2 (date of hire: 2/1/2022) completed their TB test yesterday and that they should have their results tomorrow. Staff #2 was observed working with children during today's inspection.

Plan of Correction: They should have their results tomorrow.

Standard #: 8VAC20-800-180-A
Description: Based on record review and interview, the provider has not obtained a subsequent tuberculosis (TB) screening every two years for each employee.
Evidence: Staff #3's most recent TB screening is dated 10/19/2019. The provider stated that they received another test yesterday and that they should have the results tomorrow.

Plan of Correction: They should have the results tomorrow.
