Technical Assistance:
Inspector provided guidance regarding capacity, sleeping requirements, background check requirements and training hours.

Comments:
An in-person monitoring inspection was conducted on March 25, 2022. The provider was contacted by telephone and a virtual inspection was conducted. There were 13 children present, ranging in ages from 6 months to 4 years, with 3 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 3 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-A
Description: Based on record review, a repeat background check was not completed for a staff member every five years.

Evidence: Caregiver 1 did not have a repeat check conducted every five years. Central registry background check was last conducted on 06/26/2016.

Plan of Correction: Follow up background check was sent on 3/28/2022.

Standard #: 8VAC20-800-40-A
Description: Based on observation and interview, the provider exceeded the maximum licensed capacity of the home.

Evidence:
1) At 10:00am, there were 13 children in care. At 10:15am, a child was picked up by a parent and there were 12 children in care.
2) Provider confirmed there were 13 children in case for approximately 20 minutes.

Plan of Correction: We will ensure that we keep the capacity at 12.

Standard #: 8VAC20-800-210-A
Description: Based on record review and interview, caregivers did not obtain a minimum of 16 clock hours of training annually in areas relevant to their job responsibilities.

Evidence: The caregivers did not obtain any hours of training annually. The provider confirmed all staff members have not completed the required hours of training.

Plan of Correction: We will ensure all hours are completed this year.

Standard #: 8VAC20-800-530-A
Description: Based on interview, rest mats do not have linens consisting a top cover and bottom cover.

Evidence: Provider stated children lay on rest mats without a top or bottom cover during nap time.

Plan of Correction: We will make sure all mats have a top and bottom cover.

Standard #: 8VAC20-800-600-B
Description: Based on observation, an infant spent more than 30 minutes of consecutive time during waking hours in a confining piece of equipment.

Evidence:
1) Child 1 was observed in a sit 'n play from 10:00am to 10:50am.
2) Child 2 was observed in a booster seat at 10:00am, moved to a high chair at 10:35am, and moved to another booster seat at 10:55am. At 11:10am, Child 2 was removed from the chair and moved to the floor to play. Child 2 was in a confining piece of equipment for a total of 55 minutes.

Plan of Correction: We will make sure infants and babies are allowed an hour of time in between being in chairs.
