Comments:
An unannounced inspection was conducted today between 11am and 11:45am. There were 11 children present with 2 assistant caregivers. The provider arrived at the family day home approximately 20 minutes after the start of the inspection. Inspectors discussed a second family day home that the provider has opened in a separate house. Violations were found during today?s inspection and can be viewed on the Violation Notice.

Violations:
Standard #: 8VAC20-800-30-A
Description: Based on observation, the provider did not ensure compliance with the terms of the current license issued by the department and with relevant federal, state or local laws.
Evidence: The provider currently has a maximum capacity of 10 children at any one time. During today?s inspection, 11 children were observed in care.

Plan of Correction: child part-time is no longer. Total attended 10 child.

Standard #: 8VAC20-800-30-C
Description: Based on observation and interview, the provider was not of good character and reputation.
Evidence: On 10/13/2022, an investigation of an illegal operation was initiated at 33 Dulany Lane in Sterling, Virginia. It was observed that 9 children were in attendance with 2 caregivers, and the program was operating without a state license.
The provider stated that they resided in the home and that they were unaware that they needed a state license to take care of more than 4 children.
The provider later stated that they did not reside in the home, and that they were aware that they needed a state license to operate. The provider confirmed that they resided at 20866 Derrydale Square in Sterling, Virginia and they owned two homes; one that had a state license and one that did not.
The provider later apologized for being dishonest; however, an opportunity to purchase the second home had presented itself, and they decided to offer care to additional children and operate illegally.

Plan of Correction: [Household member] began to apply for the state license for that address.

Standard #: 8VAC20-800-50-A
Description: Based on interview, the family day home does not keep a written record of children in attendance each day.
Evidence: When asked to view the daily attendance, the provider stated that she does not take attendance daily.

Plan of Correction: Attendance record is update everyday.

Standard #: 8VAC20-800-570-A
Description: Based on observation and interview, the provider did not ensure that each caregiver did not exceed 16 points.
Evidence:
1. There were 8 children observed between birth-15 months of age (4 points/child = 32 points)
2. There were 3 children observed between (16 months-23 months of age (3 points/child = 9 points)
3. Two caregivers were in the family day home with 41 points for approximately 1 hour during today?s investigation.

Plan of Correction: Now provider and 2 assistant are hours of operation.

Standard #: 8VAC20-820-120-E-2
Description: Based on observation, the findings of the most recent inspection of the facility was not posted.
Evidence: The inspection that is posted in the family day home is dated 11/29/2021. The provider?s most recent inspection was on 5/16/2022.

Plan of Correction: Now is posted on the board.
