22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site renewal inspection was conducted on 5/20/24. The on-site inspection began at 11:30 am and ended at 12:15pm. The inspector reviewed compliance in the areas listed above. There was 1 child present with 1 caregiver. The inspector reviewed 3 children?s records, 1 caregiver and 1 household member's record. The inspection included document review, a tour of the daycare area, interviews and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-830-A
Description: Evacuation procedures shall be practiced monthly.
Evacuation procedures were not practiced in March and April 2024.

Plan of Correction: We will conduct monthly escape drills.

Standard #: 8VAC20-800-830-B
Description: Shelter-in-place procedures shall be practiced a minimum of twice per year.
There were no shelter-in-place procedures practiced for 2023.

Plan of Correction: We will do shelter in place drills each year.

Standard #: 8VAC20-800-210-A
Description: Caregivers shall obtain a minimum of 16 hours of training annually in areas relevant to their job duties.
Caregiver A has 12 of the 16 training hours for 2023.

Plan of Correction: Caregiver A will get the additional training.

Standard #: 8VAC20-800-500-F
Description: Trampolines shall not be used during the hours children are in care.
On occasion the trampoline is used by daycare children.

Plan of Correction: Daycare children will not be allowed to use the trampoline.
